1961-012 AN ORDINANCE AMENDING THE ZONING AND USE DISTRICT MAP OF THE 0ITY OF DENTON, TEXAS, AS IT APPLIES TO CERTAIN PROPERTY AT THE SOUTEWEST 00RNER 0F THE INTERSECTION OF BERNARD STREET AND U. S. HIGHWAY 35E IN THE SAID CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, SO AS TO ~EMOVE THE SAID PROPE~Y FROM THE DI~.?.ING DISTRICT; PLACING THE ~AID PROPERTY IN THE BUSINESS DISTRICT; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: ~EOTION 1. That the Zoning and Use District Map of the City of Denton, Texas, be amended as follows: All that certain tract or parcel of lan~ lying and being situated in the City said County of Denton, State of Texas, being out of the A.N.B. Tompkins Survey, Ab- stract No. 1246, being particularly described as follows: BEGINNING at a point 125 feet North of the Southeast corner of a certain 10.336 acre tract of land conveyed by warranty deed from Wylie H. Barnes et ux to R. H. Tmrnbull and wife, Violet Turnbull, shown in Vol. 449, Page 628, Deed Records of Denton County, Texas, said beginning point also being 125 feet North of the South- west corner of a certain 2.02 acres tract conveyed by warranty deed from R. H. Turnbull and wife, Violet Turnbull, to John B. Morrison and wife, Arleen Morrison, shown of record im Vol. 461, Page 371, Deed Records of Denton County, Texas; THENCE West 255.51 feet parallel with the North b~anda~y line of Willowwood ~treet for a corner; THENCE North 0e 37' East 480.69' for a corner; THENOE South 88e 14, West 272.18' for a corner; TN~NCE South 47° 45' East 286, for a corner; THENCE South 40° 34' 33" West 260' for a corner; TMI~CE South 0~ - 21~ West 82.06, to the place of be- ginning, containing 4.9 acres more or less. SEOTION 2. The City Council of the City of Denton, Texas, hereby finds that such chamge is in accordance with a comprehensive plan fo~ the purpose of p~om~ting the general welfare of the City cf Denton, an4 with ~easonable consideration, among other things, for the ehamacter of the ~istrict and for its peculiar suitability for particula~uses, and with a view to conserving the value of buildings and encouraging the most appropriate use of such land for the maxi~3.m benefit to the City of Denton, Texas, and its citizens. SECTION 33 That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearimgs having heretofore been held by the Planning and Zoning Commissiom and the City Council.
