1962-001 O mNCE NO. b AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, 1961, AS SAME WAS ADOPTED AS A PART qF PARTS II AND III OF CHAPTER 13 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDIHANCE N~O. 61-19, AS SAID MAP APPLIES TO CERTAIN PROPERTY ON THE WEST SIDE OF NORTH ELM STREET IN THE CITY OF DENTONe T~AS~ AND MORE PARTICULARLY DESCRIBED HEREIN, SO AS TO REMOVE SAID PROPERTY FROM THE "A-2" - DWELLING DISTRICT A~D PLACING THE SAME IN THE "LB" - LOCAL BUSINESS DIS- TRICT, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: S~CTION 1 That the Zoning Map of the City of Denton, Texas, 1961, ~dopted as a part of Farts II and III of Chapter 13 of the Code of Ordinances of the City of Denton, Texas, under the pro- visions of Ordinance No 61-19 be, and the same is hereby, amended as follows- Ail of the hereinafter described property is hereby re- moved from the "A-2" - Dwelling District as shown on said ~p, and all provisions of Parts II and III of Chapter iS of the Code of Ordinances of the City of Denton, Texas, as provided by Ordinance No 61-19, shall hereafter apply te said property as "LB" - Local Business District prop- e~ty in the same manner as other property located in a "$B" - Local Business District All that certain tract or parcel of land situated on the West side of North Elm Street in the City of Denton, Texas, being a part of Subdivision No, 3 o~ the B~B. & C.R R Survey, Abstract No 111, consisting of a 100 foot wide lot described in a certain release from Denton Federal Savings and Loan Assn to Susie V Beyette, et al, re- corded in Volume 69, Page 511 of the Deed of Trust Records of Denton County, Texas, plus a 59 foot wide lot adsacent to the above lot on the South owned by Ida Cleo Stanley, and a 90 foot wide lot ad]acent to said Stanley lot on the South owned by Mrs 0 D Bell, and being more particu- larly described as follows- BEGINNING at the Northeast corner of said Beyette lot on the West side of North Elm Street, THENCE South with the West line of Elm Street 265 feet to the Southeast corner of said Bell lot, THENCE West with the South line of said Bell lot 162 feet, more or less, to its Southwest corner, THENCE North with the West line of the above named lots 265 feet to the Northwest corner of said Beyette lot, THENCE East with the North line of said Beyette lot 170 feet, more or less, to the place of be- ginning SECTION 2 The City Council of the City of Denton, Texas, hereby finds that such change is in accordance w~th a compre- hensive plan for the purpose of promoting the general welfare of the City of Denton, and with reasonable consideration, among other things, for the character of the district and for 1ts peculiar suitability for particular uses, and with a v~ew to conserving the value of buildings and encouraging the most appro- priate use of such land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION 3 That th~s ordmnance shall be an full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council PASSED AND APPROVED this 9th day of January, A D 1962 ~yor/ ATTEST City of Denton, Texas C~ty'S~cre~- ' City of Denton, Texas APPR%_V~.D AS ~O LEG~2~- ~ City A~torney City of Denton, Texas
