AN ORDINANCE AMENDING ARTICLE 13 06 (b) OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEX~S, BY PROVIDING
CERTAIN TERMS AND CONDITIONS FOR THE CONSTRUCTION OF
MODEL HOMES IN A SUBDIVISION AFTER THE APPROVAL OF THE
FIINAL PLAT AND BEFORE THE ACTUAL CONSTRUCTION OF WATER
D~STRIBUTION AND SE~RAGE CONNECTION SYSTEMS THEREIN,
AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That Artlcle 13 06 (b) of the Code of Ordinances
of the C~ty of Denton, Texas, be, and the same ms hereby, amended
so as to hereafter read as follows
"(b) Constructmon Requmred Before Issuance of Bumldmnq
Permmt
Approval of the fmnal plat by the Planning and
Zoning Commmsslon and the Cmty Council shall
obligate and authormze the subdivider to mnstall
water dmstrmbutlon and sewage collection systems
mn the subdlvlsmon at hms own expense mn accor-
dance wmth the constructmon plans submmtted wmth
the final plat and the City of Denton specmfmca-
tmons prmor to the mssuance of building permmts
in the subdivision, provided, however, that if
the subdivider shall enter mnto contracts wmth
reputable contractors for such constructmon ac-
cordmng to the plans and City specmflcatmons and
make an escrow deposmt mn the total amount of the
contracts, wmth a Denton bank to be pamd to the
contractor as the improvements are completed upon
the joint release of the subdmvmder and the Director
of Plannmng for approved portmons of the work, and
such escrow arrangement shall provmde that the
Cmty of Denton shall be entitled to the proceeds,
upon failure of the contractor to complete the
contract, for use in completing the work, the
Bu~ldmng Inspector shall he authorized to zssue
bumldlng permmts for the constructmon of model
homes mn such subdlvmslon upon the condmtmon that
no such model home shall be occupmed as a resmdence
and that no Certificate of Occupancy and Complmance
shall be mssued for such model homes untml such
systems are fully mnstalled and mn operation, and
provided further, that no bulldmng permmt for the
constructmon of a model hom$,as aforesamd, shall
be Issued until such subdlvmder shall have delivered
to the Building Inspector an lndemnmty agreement
whmch shall bind the subdlvmder to indemnIfy the
"Czty of Denton, Texas, agaznst any and all
clazms for damages whzch mzght zn any manner
arise out 6f the failure of the subdivider to
provide water d~strlbutlon and/or sewerage
connection systems, as aforesaid, or any failure
of the C~ty of Denton to requzre the znstallatlon
of such systems, as aforesaid"
SECTION 2 Thzs ordlnance shall become effective ~mmed~ately
upon ~ts passage
