AN ORDI~ANCE BY THE CITY COUNCIL OF THE CITY OF DENTON,
~EXASw CALLING AND ORDERING AN ELECTION TO BE HELD ON
THE 3RD DAY OF APRILm A.D 1962, THE SAME BEING THE
FIRST TUESDAY IN SAID MONTH, FOR THE PURPOSE OF ELECTING
TWO (2) COUNCILMEN FOR THE CITY OF DENTON IN ACCORDANCE
WITH THE PROVISIONS OF ARTICLE 3, SECTION 3 O1 (a) OF
C RTER OF THE CITY OF ENTON, TE S, ESTABLISHING
HOURS AND PLACE FOR THE SAID ELECTION, PROVIDING FOR
IUBLICATION OF THIS ORDINANCE AND THE POSTING IN THREE
UBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF SAID
ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP THE
OFFICIAL BALLOT, CAUSING THE SAME TO BE PRINTED AND DE-
LIVERED TO THE PRESIDING OFFICER, PROVIDING FOR THE MAKING
OF OFFICIAL RETURNS OF SAID ELECTION, PROVIDING FOR THE
CANVASSING OF THE RETURNS OF SAID ELECTION AND DECLARING
~E RESULTS OF SAME BY THE CITY COUNCIL, AND DECLARING
AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1
~nat an election shall be held xn the Municipal Building in
the C~ty of Denton, Texas, between the hours of 8 00 o'clock a m
and 71 00 o'clock p m on the 3rd day of April, A D 1962, the
same being the first Tuesday of said month, for the purpose of
electing two (2) councilmen for the City of Denton, in accordance
w~th Ithe provisions of Article 3, Section 3 01 (a) of the Charter
of the City of Denton, Texas
!SECTION 2
,That the two candidates who receive the highest number of
votes shall be declared elected to the City Council of the City
of D~nton
:SECTION 3
IThat notice of said election shall be given by the posting
of t~ue copies of this ordinance, signed by the Mayor and attested
by the city secretary in three public places ~n the said City,
one ~f which places shall be at the Municipal Building, for thirty
(30) ~onseoutmve days prmor to the date of the samd election and
thms ordinance shall be publmshed in full one time mn the Denton
Record-Chronicle at least thmrty (30) days prior to the samd
election
SECTION 4
That Jewell Smmth ms hereby appomnted Presmdlng Judge of
samd electmon, and the samd Jewell Smmth shall appoint such
assistants as may be necessary to properly conduct samd electmon
SECTION 5
That the City Secretary shall make up the official ballot
from the names presented to him by applmcatmon or nommnatmng
petmtions as provmded by Artlcle 3, Sections 3 02 and 3 03 of
the Charter of the Cmty of Denton, Texas, and he ms hereby
authormzed and dmrected to have the ballots to be used mn such
electlon prmnted and delivered to the samd Presmdmng Judge
SECTION 6
That lmmed~ately after the countmng of the votes the Pre-
smdlng Judge shall delmver the offmcmal returns of the election
to the City Secretary
SECTION 7
That on the Monday next following the electmon, the Cmty
Councal shall canvass the returns and declare the results whmch
shall be recorded in the minutes of the Council
SECTION 8
That the two candidates who receive the highest number of
votes, shall be declared elected and the Mayor shall delmver
Certmflcates of Electmon to the successful candmdates If two
candidates shall tie, the Council shall order a second electmon
to be held on the 14th day after the fmrst electmon at whmch
only ,the names of the two candidates who recemved the same
number of votes at the first election shall be printed on the
ballot In the event of a tie at the second election, the two
candidates shall cast lots to determine which one shall be declared
elected
SECTION 9
Th~s ordmnance shall become effective zmmedzately upon ~ts
passage
