election was held in the City of Denton, Texas, resulting favorably to the issuance of $1,600,000 00 of revenue bonds for the purpose of improving and extending the City's Wate~rks System and $2,600,000 00 of revenue bonds for the purpose of improving and extending the City's Sewer System, and ~REAS, on J~ly 12, 1960, the City Council of the City of Denton, Texas, passed an ordinance directing the issuance of $1,700,000 O0 City of Denton, Texas, Water and Sewer System Revenue Bonds, Series 1960, dated July 15, 1960 (hereinafter called "Series 1960 Bonds"), and ~, said bonds above described and said authorizing ordinance reserved to the City the right to issue Additional P~rity Revenue B~ads, under the conditions set forth in Section 19 of said Series 1960 authorizing ordinance, and ~S, the conditions prescribed in Section 19 of said 1960 authorizing ordinance have been i~lfilled and exist so that the City now has authority under said Section to issue the Additional Bonds herein authorized, and ~, at this time it is considered proper to sell only One Million ($1,000,000 00) Dollars of bonds, to-wit $ ~00~000 O0 for the purpose of improving and extending the Waterworks System and $ ~00,000 00 for the purpose of improving and extending the Sewer System reserving the right to the City to sell all or any part of the remaining $ ~45~000 O0 of bonds for improving and extending the waterworks system and $1~365~000 00 of bonds for improving and extending the sewer system, all to be considered when issued as a part of the same series of indebtedness insofar as liens and rights are considered, and ~rltEREAS, it is considered to be to the best interest of the City that said bonds be authorized in one issue secured by a first lien on and pledge of the net revenues from the operation of the City's Waterworks and Sewer System, and ~, it is now necessary and proper th~ t the City Council proceed with the issuance of such revenue pursuant to the Constitution and Statutes of the State of Texas, in- cluding particularly Articles 1111 to 1118, both inclusive, 1925, Revised Civil Statutes of Texas, as amended, and Chapter 163, Acts of the Regular Session of the Forty Second Legislature, as amende~, there shall be issued "City of Denton, Texas, Mater and Sewer System Revenue Bon~[s, Series 1962", aggregating One Million ($1,000,000 00) Dollars, numbered One (1) to One Thousand (1,000), both inclusive, of the denomination of One Thousand ($1,000 00) Dollars each 2 That aaid bonds shall be dated January 15, 1962, and presnmed to forego and renounce his equities in favor of subsequent holders for value without notice, and to agree that this bond and each of the coupous hereto attached, may be negotiated by delivery same manner as if all of said covenants, provisions, powers and conditions have been here flAlly set forth The said Series 1962 Bonds and the Series 1960 Bonds shall be on a parity in all respects so that no bond of either series shall be entitled to any preference or priority over any bond of the other series 10 In addition to the amount required by said ordinance of July 18, 1960 to be deposited
