AND ARTICLE 9 14 (k) OF THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TE~Sw SO AS TO PROHIBIT THE
BURNING OF GARBAGE~ TRASH AND RUBBISH ON ANY PORTION
OF THE CITY OF DENTON'S GARBAGE~ TRASH AND RUBBISH
DISPOSAL GROUNDS~ AND SO AS TO PROHIBIT PERSONS FROM
ENTERING THE CITY OF DENTON'S GARBAGE~ TRASH AND RUB-
BISH DISPOSAL GROUNDS B~TWEEN THE HOURS OF 5-00 P M
AND 8:00 A.M ON THE FOLLOWING DAY ON WEEK DAYS OR
AT ANY TIME ON SUNDAYS, PROVIDING FOR A FINE UPON
COI~ICTION IN ANY AMOUNT NOT LESS THAN FIVE DOLLARS
($5 00) NOR MORE T~AN ORE HUNDRED DOLLARS ($100 00)
FOR VIOLATION OF THE PROVISIONS OF THIS ORDINANCE,
PROVIDING FOR THE PUBLICATION OF THE CAPTION OF THIS
ORDINANCE, AND DECLARING AN EFFECTIVE DATE.
WHEREAS, heretofore on February 28, 1961, the City Council
ordered the immediate cessation of all burning of garbage, trash
and rubbish at ~ts disposal grounds and ordered that sanitary
landfill practices be adopted ~n accordance with procedures ap-
proved by the Texas State Department of Health, and
WHEREAS, notwlthstand~ng the cessation of burning by the
City of Denton, the general public has continued to enter the
C~ty of Denton's garbage, trash and rubbish d~sposal area and
burn garbage, trash and rubbish at hours when the C~ty's
supervisors are off duty, and
WHEREAS, ~t appears necessary to adopt further regulations
in order to prohibit the burning of garbage, trash and rubbish,
as ~foresald, now therefore
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That Article 9 14 (]) (3) of the Code of Ordi-
nances of the City of Denton, Texas, be, and the same is hereby,
amended so as to hereafter read as follows
"(3) Ail 3unk and other material on the garbage,
trash and rubbmsh dzsposal area belongmng
to the Cmty of Denton, ms the property of
the Cmty of Denton, and it shall be unlawful
for any person to separate, collect, remove
or dmspose of any junk from the Cmty garbage,
trash and rubbmsh area, except under the wrmtten
authormty of the City Health Offmcer"
SECTION 2 That Artmcle 9 14 (j) (4) of the Code of Ordm-
nances of the Cmty of Denton, Texas, be, and the same ms hereby,
amended so as to hereafter read as follows
"(4) It shall be unlawful for any person to enter
the Cmty of Denton's garbage, trash and
rubbmsh dmsposal grounds, except employees
of the Cmty Sanitation Department, persons
operatmng under a permmt granted under the
provmslons of thms Artmcle or persons de-
lmvermng thezr own garbage, trash or rubbish,
and mt shall be unlawful for any person to
enter the Cmty of Denton's garbage, trash
and rubbish dmsposal grounds between the
hours of 5 00 p m and 8 00 a m on the
followmng day on week days or at any tmme
on Sundays "
SECTION 3 That Article 9 14 (J) of the Code of Ordmnances
of the C~ty of Denton, Texas, be, and the same ms hereby, amended
by the addmt~on of an addmtmonal subsectmon which shall hereafter
read as follows-
"(5) Ail burning of garbage, trash and rubbmsh
on the czty of Denton's garbage, trash and
rubbish dmsposal grounds is prohmbmted and mt
shall be unlawful for any person to burn gar-
bage, trash or rubbzsh on any portmon of such
grounds "
SECTION 4 That Artmcle 9 14 (k) of the Code of Ordmnances
of ~he C~ty of Denton, Texas, be, and the same ms hereby, amended
so as to hereafter read as follows
"(k) Dlsposal of Garbaqe, Trash or Rubbmsh
It shall be unlawful for any person to dis-
pose of any garbage, trash or rubbish in
any place in the City of Denton, Texas,
other than a place desmgnated and authormzed
mn wrmtmng by the City Health Officer"
SECTION 5 That any person, assoezatlon of persons, firm
or corporation v~olatzng any provision of thzs ordinance shall
be f~ned upon conv~ctlon in any amount not less than Fzve Dollars
($5 00) nor more than One Hundred Dollars ($100 00)
SECTION 6 That the captzon of this ordinance shall be
published in the Denton Record-Chronlcle, the official newspaper
of the C~, twzce wz~ln ten days after the passage of thls
ordlnance
SECTION 7 That thzs ordinance shall heeome effective
fourteen (14) days from the date of zts passage
