1962-014 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF DENTON, TEXAS, BY THE ADOPTION OF ARTICLE
13 071 REQUIRING SUBDIVIDERS TO MAKE PROVISION FOR
NATURAL GAS SERVICE IN SUBDIVISIONS PRIOR TO ISSUANCE
OF BUILDING PERMITS, REQUIRING INSTALLATION OF NATURAL
GAS MAINS AND SERVICE LATERALS PRIOR TO PAVING, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the code of ordinances of the City of Denton,
Texas, be, and the same is hereby, amended by the adoption of
Article 13 071 which shall hereafter read as follOws
"ARTICLE 13 071 GAS INSTALLATIONS
(a) prg~iS.io~_ for Natural Gas Service Re~uire~.
Prior to the issuance of building permits
within the subdivision, the subdivider shall
furnish the Building Inspector with a satis-
factory certificate from the person, associa-
tion of persons, firm or corporation engaged
in the business of providing natural gas
service to the public within the City of
Denton, Texas, that the subdivider has made
satisfactory arrangements with such person.,
association of persons., fir~ or corporatio~
for the installatlon of all natural gas mains
and service laterals necessary to provide
natural gas service to each lot in such sub-
division
(b) installation_ ~eg~/ired
Within thirty (30) days after receiving written
notice so to do from the subdivider, the Rersq~,
association o~f persons, firm, or corporation
furnishing the certificate mentioned in sub-
section (a) of this Article shall proceed to
install all natural gas mains within the streets
of said subdivision and all service laterals
shall be extended to a point beyond the curb
line of such streets; such work shall be fully
performed within a reasonable time after commence-
ment, as aforesaid
(c) Paving Not to be Performed Until Mains and
Laterals Installed
No paving shall be performed in any such sub-
division until the work mentioned in subsection
(b) of this Article shall have been fully per-
formed
(d) Franchises Subject to Compliance with this
Article
Ail franchises hereafter finally granted to any
~erson, as,soclation o_~f persgDs, firm or corpora-
tio~ for the service of natural gas, to the
public in the City of Denton, Texas, shall be
subject to the terms of this Article, and the
failure on the part of any such franchise holder
to fully comply with the terms of this Article
shall constitute good and sufficient cause for
the immediate revocation of any such franchise"
SECTION 2 That this ordinance shall be effective immediately
upon its passage
