CEEDINGS AND CONTRACT CONCERNING SAID ASSESSMENTS,
PROCEEDINGS AND IMPROVEMENTS, DIRECTING THE CITY MANAGER
OF THE CITY OF DENTON, TEXAS, TO GIVE NOTICE OF SAID
HEARING AS REQUIRED BY LAWS OF THE STATE OF TEXAS, AND
THE C~ARTER OF THE CITY OF DENTON, DECLARING AND PRO-
VIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY
UPON PASSAGE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1 The City Council of the City of Denton, Texas,
hereby finds and determines~
(a) That the City Council of the City of Denton, Texas,
has heretofore by Ordinance No 62-13 enacted on the
24th day of April, A.D 1962, determined the necessity
for, and ordered the improvement of portions of Eagle
Drive and sundry other streets in the City of Denton,
Texas, within the limits hereinafter defined, in the
manner and according to the City of Denton Street and
Roadway Specifications therefor, which City of Denton
Street and Roadway Specifications have heretofore been
approved and adopted by said City Council Said streets
and the portions to be improved, designated by Unit
N~mbers are as follows~

l(b) That a notice duly executed in the name of the City
of Denton, Texas, of the enactment of the above de-
scribed ordinance has heretofore been filed with the
County Clerk of Denton County, Texas, the county in
which the said City of Denton is situated
(c) That said City Council after having duly advertised
for bids in the manner as required by law and the
Charter of the City of Denton, did award the contract
for the construction of said improvements to Public
Construction COmpany, upon its lowest and best bid
therefor, and said contract which is dated ~
~ ~ , 1962, has been executed by Public
Construction Company, and by the City of Denton was
authorized by Resolution heretofore on the ~ ~--~
day of May, 1962, passed by said City Council, and
the performance bond required by law and said contract
has been properly furnished by said P~blic Construction
Company and approved by and accepted by the City Council,
all as required by law and the Charter of the City of
Denton, Texas.
(d} That the City Council has caused the Director of
Public Works to prepare and file estimates of the
costs of such improvements and estimates of the
amount per front foot to be assessed against the
property abutting said streets within the limits
defined, and the real and true owners thereof; and
the Director of Public Works has heretofore on this
date filed said estimates and a statement of other
matters relating thereto with said City Council,
and the same has been received, examined and approved
by said City Council, and that in accordance with
said statement of estimates so filed by said Director
of Public Works and herein approved, the amount of
said estimated costs as are hereinafter stated and
set out in the schedule contained in Section 2 hereof
SECTION 2 The written statement and report of the Director
of Public Works heretofore filed with the City Council, showing the
estimated costs of all the improvements on each of said streets or
Units, within the limits above defined showing the amounts per front
foot ~roposed to be assessed against the abutting property and the
real a~d true Owners thereof, on each of said streets or Units, for
said improvements, showing the total estimated costs of said im-
provements on each of said streets or Units proposed to be assessed
against and paid by the abutting property and the real and true
Owners thereof, showing the total estimated costs of said improve-
ments on each of said streets and Units proposed to be paid by the
City of Denton, Texas, and showing other matters relative thereto,
havlnglbe~n received and examined by the City Council, said report
and the estimates therein shown are hereby in all things approved
and adopted' and it is hereby found and determined by the City
Council that the estimated amounts of the several respective
items of costs of the said ~mprovements as above described on

~ECTION 3 A portion of the cost of said improvements
shall be paid and defrayed by the City of Denton, Texas, and a
portion of the cost thereof shall be assessed against and paid
by the property abutting upon said streets within the limits above
defined, and the real and true o~rners thereof, in accordance with,
and in the manner provided by the Acts of the 40th Legislature of
the State of Texas, First Called Session, Chapter 106, known and
shown,as Article 1105-b of Vernon's Annotated Civil Statutes of
Texas, as amended, and the total cost of said improvements on each
of said streets or Units as herein above described, shall be and
the same are hereby apportioned by the said parties and shall be
paid and defrayed as follows=
(a) The City of Denton shall pay all of the cost of drainage
installations wherever located, all of the cost of ex-
cavation, base preparation, base and surfacing within
street and alley intersections, thirty-three and one-
third percent (33 1/34) of the cost of excavation, base
preparation, base and paving of a street surface thirty
feet in width, and one hundred percent (100~) of the
cost of excavation, base preparation, base and surfacing
for the excess width of paving any street surface over
thirty feet in width where said excess width is deemed
by the Director of Public Works of the City of Denton
to adequately handle present and future traffic needs.
(b) The remainder of the costs of such improvements shall
be assessed against the respective abutting DroDerties
and the real and true owners thereof in accordance with
the City Charter and the Statutes of Texas herein re-
ferred to Such assessments shall be made according
to the "Front-Foot Rule", in proportion as the frontage
of each parcel of property is to the whole frontage
improved, unless the application of such rule would,
in the opinion of the City Council, in particular cases,
result in injustice or inequality, in which cases the
City Council shall apportion and assess such costs in
such proportions as it may deem 3ust and equitable,
having in view the special benefits in enhanced value
to be received by such parcels of property and the
owners thereof, the equities of such owners, and the
ad3ustment of such apportionment as to Droduce a sub-
stantial equality of benefits received and burdens
imposed No assessment shall be made against any
abutting proDerty or the real and true owners thereof
for costs in excess of the benefits to such proDerty
in enhanced value thereof by means of such improvements
(c) The several sums above mentioned and assessed against
said Parcels of property and the owners thereof and
interest thereon at the rate of eight per centum (8~)
per annum on the initially deferred balance, together
with reasonable attorneys' fees and costs of collections
if incurred, are hereby declared to be and are made a
lien upon the respective parcels of property against
which the same are assessed, and a personal liability
and charge against the real and true owners of such
property, whether such owner be named herein or not,
and the said liens shall be and constitute the first
enforceable lien and claim against the property on
which such assessments are levied, and shall be a first
and paramount lien thereon, superior to all other liens
and claims except state, county, school district and
city ad valorem taxes
(d) (1) The sums so assessed against the abutting property
and the owners thereof, shall become due and pay-
able as follows, to wit, in thirty-six (36) equal
installments, the first payable on or before thirty
(30) days from the completion and acceptance of
the improvements of the Unit upon which the property
abuts, and one (1) each month thereafter until the
total amount is paid, deferred payments shall bear
interest from the date of such completion and
acceptance at the rate of eight per centum (8~)
per annum on the initially deferred balance, pay-
able monthly with each installment, so that upon
the completion and acceptance of the improvements
in a particular Unit, assessments against such
completed and accepted Unit shall become due and
payable in such installments, and w~th interest
from the date of such completion and acceptance
(2) Provided, however, that any owner shall have the
right to pay the entire assessment, or any in-
stallment thereof, before maturity, by payment of
principal and accrued interest, and further provided
that if default shall be made in the payment of
any installment of principal or interest promptly
as same matures, then the entire amount of the
assessment upon wh%~h such default is made shall,
at the option of the City of Denton, or its assigns,
be and become immediately due and payable, and shall
be collectable, together with reasonable attorneys'
fees and costs of collection, if incurred
(e) The assessed portion of the cost of such improvements
may be further secured by Mechanic~s Liens to be executed
in favor of the City of Denton, but Certificates of
Special Assessment shall be issued in favor of the City
of Denton, whether the owners have executed such Mechanic's
Liens or not
SECTION 4 A hearing shall be held and given to the real and
true owners of, and all owning or claiming any interest in any
property abutting upOn said streets or Units within the limits
above defined, and to all others owning, claiming or interested in
said property or any of said matters, as to the assessments and as
to the amount%u be assessed against each parcel of abutting property,
and the real and true Owners thereof, and as to the special benefits
if any, to said property to be received from said improvements,
and concerning any error, invalidity, irregularity or deficiency
in any proceedings or contract with reference thereto or con-
cerning any matter or thing connected therewith, which hearing
shall be held by the City Council of Denton, Texas, in the Council
Chambe= of the Municipal Building of the City of Denton, Texas,
at ~,O o'clock A.M , on the _~_~ day of --~'-- ,
1962, at which time and place all persons, firms, corporations or
estates Owning or claiming any such abutting property, or any in-
terest therein, and their agents or attorneys, and persons interested
therein, and their agents Or attorneys, and persons interested in
said proceedings, shall be notified to appear and to be heard in
person, or by counsel, and may offer evidence, and said hearing
may be adjourned from day to day and from time to time and kept
open, until all evidence and protests have been duly offered and
heard, ~and the City Manager of the City of Denton, Texas, is
hereby directed to give notice of said hearing by publication of
Notice in some newspaper of general circulation in the City of
Denton, Texas; said Notice shall be published at leak three (3)
tames in said newspaper before the date set for said hearing,
the first of which publications shall be at least ten (10) days
prior to the date of said hearing, and such notice by publication
shall be valid and sufficient, without any further form or character
of not~ce, as provided for by and in accordance with the terms and
provisions of said Chapter 106 of the Acts of the First Called
Session of the 40th Legislature of the State of Texas, known as
Article l105-b of the Revised Civil Statutes of Texas, as amended,
however, the said City Manager may, in addition to the contents
of the Notice of said hearing, as required by law and the Charter
of sa£d City, which shall be for all purposes valid and sufficient
in itself, include in any one or all of the publications of said
Notice such further data and information regarding such proposed
improvements and assessments as the City Manager may deem proper
and such general statement in connection therewith as the City
Manager may desire, to acquaint those to whom the Notice is
directed with the facts and matters concernIng said improvements,
assessments and hearing The form of said Notice, as required
by law and said Charter, having been heretofore submitted to the
City Council by the City Manager, same is hereby approved for
publication.
~ECTION 5 Following such hearing as above provided,
assessments will be levied against said abutting property, and
the real and true owners thereof for that portion of the costs
of said improvements hereinabove determined to be payable by
said abutting property and the real and true owners thereof,
which assessments shall be a first and prior lien upon said abut-
ting property and a personal liability and charge against the real
and t~ue owners thereof In levying said assessments, if the name
of the owner be unknown, it shall be sufficient to so state the
fact, and it shall be unnecessary to give the correct name of
any such owner and no error or mistake in attempting to name such
owner or in describing any of said property shall invalidate any
assessment or certificate issued in evidence thereof, but never-
theless, the real and true owners of said abutting property shall
be valid whether or not such owner be named, or correctly named,
or said property correctly described therein
SECTION 6,,, The construction and Installation of the improve-
mentslherein ordered in each Street Unit herein designated and
described shall be separate and independent of the construction
and installation of such improvement in each and every other
Street Unit The assessments to be levied for the improvements
in each Street Unit shall be separate and distinct from the
assessments to be levied in every other Street Unit, and in makinq
and levying assessments against property fc~ the improvements in
one unit, no material or substance in connection with any other
Unit shall be considered, all as fully and to the same extent as
if separate contracts were executed and separate proceedings
had with reference to each such Street Unit or portion of street
SECTION 7 This ordinance shall become effective immediately
upon its passage
