1962-031 o ANCE AN ORDINANCE AMENDING ARTICLE 16.24(a)(1) OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, SO AS TO ALTER THE PRIMA FACIE SPEED LIMITS ESTAE- ~ISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 9 OF ARTICLE 827a OF THE PENAL CODE OF THE STATE OF ~XAS~ iUPO~ PARTS OF ~UNIVERSITY DRIVE ( TEXAS STATE GHWAY NO. 24 ), NORTH LOCUST STREET AND McKINNEY STREET, WITHIN THE CORPOP~TE LIMITS OF THE CITY OF bENTON, TEXAS, AS SET OUT IN THIS ORDINANCEI PRO- VIDING A PENALTY OF A FINE OF NOT LESS T~AN ONE DOLLAR ($1.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200.00) FOR THE VIOLATION OF THE SPEED LIMITS ESTABLISHED BY THIS ORDINANCEs, AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 8 of Article 827a, Vernon~s Penal Code of the State of Texas, provides that whenever the governing body of the City shall determine upon the basis of an engineering and t~&ffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pave- ment and other circumstances on such portions of said streets or highways, ss well as the usual traffic thereon, said govern- ing b~y may determine and declare a reasonable and safe prima facielspeed limit thereat or thereon by the passage of an ordi- nance~ which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway~ now therefore THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of SeCtion 8 of Article 827a, Vernon~s Texas Penal CO~e, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe~ and such speed limits are hereby fixed at the rate of speed ,indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows, and Article 16 24(la)(1) of the Code of O~dinances of the City of Denton, Texas,~ is hereby amended so as to read as follows for the streets and/or highways lndi~ated~ Street EXtent Speed Limit North Locust from the intersection of 50 mph said street with the north city limits line, south 5287 feet to a point" Street Extent Speed Limit ,University Drive from the intersection of 50 mph (Texas State said highway with the east Highway No 24) city limits line, west 7150 ' feet to a point from the aforesaid point, 45 mph west 4400 feet to a point" Street Extent Speed Limit ~McKinney from the intersection of 45 mph said street with the east city limits line, west 7050 feet to a point" ~ECTION 2 The Chief of Police is hereby authorized and directed to cause appropriate signs to be erected indicating such speed zones SECTION 3 Any person violating any speed limit established by this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any amount not less than One Dollar ($1 00) nor more than Two Hundred Dollars ($200 00) SECTION ~, This ordinance shall become effective immediately upon its passage and ~ublication as required by law ~ASSED AND APPROVED this 13th day of November, A D 1962 l~yor City of Denton, Texas ATTEST~ ~ity Secretary City of Denton, Texas City Of Denton, Texas
