1963-023 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, DECLARING UNLAWFUL THE LITTERING OF A PUBLIC PLACE OR OF PROPERTY BELONGING TO ANOTHER, PROVIDING A PENALTY THEREFOR, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION,I That the Code of Ordinances of the City of Denton, Texas, is hereby amended by including new Article ~, /~/ in Chapter ~ ~of said Code of Ordinances which shall hereafter read as follows ARTICLE ~/~ UNLAWFUL TO LITTER PUBLIC PLACE OR ANOTHER'S PROPERTY It shall be unlawful for any person or persons to throw, place, or deposit or cause to be thrown, placed, or deposited or suffer or permit his or her servant or any other person in his or her family to throw or deposit in any street, alley, gutter, ditch, lot or other place in this City the carcass of any dead animal or fowl or any meat, fish, hides, skins, bones, offal, manure, fruit, vegetables, melon rinds, fruit peelings, slop, or other unsound or offensive matter or matter liable to become offensive or injurious to the health of those who reside in the vicinity or allow any such substances to remain in or about or upon any premises owned or controlled by him, her, or them, and any person violating said provision in any respect shall be punished by a fine of not less than ten nor more than one hundred dollars, or to throw, place, or deposit or cause to be thrown, placed, or deposited or permit or suffer his or her servant or other persons in his or her family to throw, place, or deposit in any street, alley, gutter, ditch, or other public place, or upon any lot or other premises not owned or controlled by him or her, tires, bottles, cans, loose paper, rags, scraps of leather, shavings, dishwater chips, or other trash SECTION 2 That if any section, subsection, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereof to any person or circumstances is held invalid by any court of competent ]ur~sdlct~on, such holding shall not affect the validity of the remaining portions of this Ordinance, and the City Council of the C~ty of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION 3 That this Ordinance shall become effective fourteen (14) days from the date of Its passage, and the City Secretary is hereby directed to cause the caption of this Ordinance to be published twice in the Denton Record Chronlcal within ten (10) days of the date of its passage PASSED AND APPROVED thzs //~ ~ day of ~- CE A~ ~C~ , A D 1963 Warren Whltson, Jr , Mayor City of Denton, Texas ATTEST Br(~m/~'rHolt, City Secretary C~ty of Denton, Texas APPR3DVED %8 TO LEGAL FORM J~ Q Barton,- City Attorney /~ty of Denton, Texas
