1964-057 AN ORDINANCE PROVIDING FOR PARTICIPATING IN THE
SUPPLEMENTAL BENEFITS FUND OF THE TEXAS MUNICIPAL
RETIREMENT SYSTEM BY ALL DEPARTMENTS OF THE CITY
GOVERNMENT WHICH NOW PARTICIPATE IN THE TEXAS
MUNICIPAL RETIREMENT SYSTEM, AND PROVIDING FOR
PAYMENT OF THE CITY'S CONTRIBUTIONS ON ACCOUNT
OF SUCH PARTICIPATION.
WHEREAS, the governing body of the City of Denton, Texas has
heretofore elected to have the employees of designated
departments of the city government participate mn the
Texas Municipal Retmrement System, such departments
being hereinbefore called "partlcmpatmng departments",
and
WHEREAS, Chapter 312, Acts Regular Session, 56th Legmslature
provmdes for establishment in said System of a
Supplemental Benefits Fund to provmde for addltmonal
dlsabllmty benefits for service connected disabilities,
and
WHEREAS, the governmng body of the Cmty of Denton, Texas, finds
that it will be mn the public interest to provide for
partlclpatlon of employees of such departments in said
Supplemental Benefmts Fund,
now therefore
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I
The City of Denton, Texas, by its City Council hereby
elects to have the employees of all participating departments of
samd cmty as above defined participate in and be covered by the
Supplemental Benefits Fund of the Texas Munlcmpal Retirement
System, as provmded by Chapter 312, Acts Regular Session, 56th
Legislature, and all the benefits and obligations of participation
in sald Fund are hereby accepted by the City as to such employees
SECTION II
The City Manager is hereby directed to notify the Board
of Trustees of the Texas Munlcmpal Retirement System that the
Cmty of Denton has elected to partlcmpate and have the employees
of the above mentioned departments participate'mn the Supplemental
Beneflts Fund of said System
SECTION III.
Each person who becomes an employee of any partmclpatlng
department on or after the effective date of participation of
such department in said Fund shall as a condmtlon of hms employment
be covered into the Supplemental Benefmts Fund of samd System
The Clty of Denton, Texas, may ~n the future refuse to add new
departments or new employees to said Fund, but shall never dls-
continue as to any members who are covered ~nto the Fund
SECTION IV.
The D~rector of F~nance is hereby directed to remit monthly
to the Board of Trustees of the Texas Municipal Retirement
System at its office in Austin, Texas, as the City's contrib-
utions to the Supplemental Benefits Fund of the Texas Municipal
Retirement System, such percentage of earnings of the above-
mentioned employees of said C~ty as may be fixed by the Board
of Trustees of the Texas Municipal Retirement System, provided
that the rate of contribution to sa~d Fund shall not exceed
one-half of one percentum (~) of the earnings of the employees
of said City who are covered under said Fund, and such official
shall make for the City such reports as the Board of Trustees
of the Texas Municipal Retirement System may prescribe
SECTION V
Participation of the above-mentioned employees in the
Supplemental Benefits Fund shall be effectIve January 1, 1960,
or on such later date as the Board of Trustees of the Texas
Mun~clpal Retirement System shall declare sa~d Fund to be
operative
