1964-052 ORDImNCE No AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, REQUIRING A LICENSE TO DEAL IN PREDOMINANTLY USED OR SECOND-HARTD MERCHANDISE, REQUIRING CERTAIN RECORDS THEREFOR, REPEALING CONFLICTING ORDINANCES PROVIDING A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I. That the Code of Ordanances of the City of Denton, Texas, is hereby amended by substatutang new subsections (a)(3), (d) and (g) of Article 10 05 in Chapter Ten of said Code of Ordinances which shall hereafter read as follows (a) Definitions (3) Second-hand Dealer A second-hand dealer is any person, partnership or corporataon carryang on or pursuing the business of buying, sellang, barterang or exchanging predominantly used or predomanantly second-hand motor vehacles, t~res and tubes, clothang, machanes, firearms, weapons, radaos, appliances or devices, or parts of machanes, appliances or devaces A dealer wall be deemed to be pre- dominantly an such business af more than one-half (%) of h~s transactaons during any month of the calendar year involves used or second-hand merchandase (d) Investaqataon of Applicants (Repealed) (g) Required Reports (1) Every ]unk dealer or second-hand dealer shall legably write, in duplicate, an offlcaal report, the form of whach is to be approved by the Caty Secretary, of any junk or second-hand merchandise purchased by or deposated for any purpose with such dealer, together %tth an accurate de- scription in the English language of the articles purchased or deposited, the amount of money paid for same or loaned thereon, the time and date of the purchase or deposit, the name, sex, and address, if known, of the person sellang or deposltlng said 3unk or second-hand merohandase (2) The official reports shall be numbered consecutively, and signed by the ]unk dealer or second-hand dealer or has agent (3) The reports required an thas paragraph shall at all times, durzng ordinary working hours, be opened to the inspection of the Chxef of Police or any Polace Officer 14) If such reports are not accurately kept and avaalable, ~he entire inventory of the dealers business shall be sub]eot to reasonable inspection by the Chief of Police or any Police ~fflcer SECTION II That all ordinances or parts of ordinances in force when the provisions of this ordinance become effective whzch are znconslstent or in c onflzct wzth the terms or pro- vzszons contazned zn this ordznance are hereby repealed to the extent of any such conflzct S~CTION III That ~f any section, subsection, paragraph, sentence, clause, phrase or word zn this Ordinance, or appllca- tzon thereof to any person or circumstances zs held znvalzd by any court of competent ]urzsdzctlon, such holdzng shall not affect the valzdzty of the remalnzng portions of this Ordznance, and the Czty Counczl of the City of Denton, Texas, hereby declares zt would have enacted such remaznzng portzons despite any such znvalzdzty SECTION IV That this Ordlnance shall become effective fourteenth(14) days from the date of zts passage, and the Czty Secretary zs hereby dzrected to cause the caption of thzs Ordznance to be publzshed twzce zn the Denton Record Chronzcle wlthzn ten (10) days of the date of zts passage PASSED A~-D APPROVED th~s ~day of / , A D 1964 Warren Whltson, Jr , Mayor ~a~¥] of Denton, Texas ATTEST APPROVED AS TO LEGAL FORM tyQ Barton,C~ty Attorney of Denton, Texas
