1964-051 O I NCE NO. AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DENTON, TE)~S, PROVIDING REQUIREMENTS FOR THE INSTALL~- ATION OF STREET LI6HTS, PROVIDING FOR PAYMENT OF SAME BY THE CITY, SPECIFYING CERTAIN EXCEPTIONS THERETO, REQUIR- ING PARTICIPATION FOR USE OF ME~AL POLES OR UNDERGROUND INS~ALIATIONS, REPEALING CONFLICTING ORDINANCES, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ECTIO~ I That the Code of Ordinances of the City of Denton, Texas, ms hereby amended by adding new Article 17 111 to Chapter Thirteen of sazd Code of Ordinances which shall hereafter read as follows ARTICLE 17 111 - STREET LIGHTING SERVICES (a) Street Llghtlng - Conventional Overhead Installation On Standard Wooden Pole Structure Wherever practicable and in keeping wzth the accepted practices of required lllumlnatmon standards the Czty of Denton shall Install street lighting in all subd~vxs~ons at no cost to the Developer or the Property Owner The City of Denton shall determmne the location of all lighting and the Developer or the Property Owner shall provide the necessary easements for constructzon and maintenance of installed equipment (b) Street Lxghtlng - Metal Street Lighting Standards Installed with Conventional Overhead Construction Wherever practicable and in keeping with the accepted practices of requlred illumination standards the City of Denton shall install or cause to be installed street llghtlng in all subdivisions, but such street llghtlng on metal poles shall not be installed until the Developer or the Property Owner shall have paid to the Department of Public utilities, in advance, the sum of Sixty Flve Dollars ($65 00) for each installed metal standard All material types are to be selected, furnished and znstalled by the City of Denton, and the Developer or the Property Owner shall provide the necessary easements for construction and maintenance of xnstalled equipment c) Street Lighting - Underground Installatzons on Metal Street Lighting Standards Wherever practlcable and in keeping wzth the accepted psactl~es of required illumination standards the Clty of Denton shall Install or cause to be installed street llght~ng in all subdlvzslons, but such street lxght~ng on metal poles and underground installations shall be installed on a fzfty percent (50%) share basks The City of Denton shall share in the installation cost in the amount of fifty percent (50%) and the Developer or Property Owner shall share in the installation cost in the amount of fifty percent (50%) The required nunf0er, location and material types shall be determined by the City of Denton In the event that a higher level of illumination is required (1 e for intersections, high density traffic or pedestrian areas, etc ) the City of Denton will bear the additional cost incurred in the required larger fixture and ballast over and above the prescribed standard 250 Watt Mercury Vapor Residential Lighting Fixture, and the Developer or Property Owner shall provide the necessary easements for construction and maintenance of installed equipment SECTION II That all ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provls- ions contained in this ordinance are hereby repealed to the extent of any such conflict SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or applica- tion thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION IV.
