1964-045 O ImNCE NO & AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF NTON, TE~S, 1961, AS SAME WAS ADOPTED AS A PART OF RTS II AND III OF cHAPTER 13 OF THE CODE OF ORDINANCES F THE CITY OF DENTON~ TE~S~ BY ORDINANCE NO 61-19, ND AS SAID MAP APPLIES TO CERTAIN PROPERTY LOCATED N THE NORTHEAST CORNER OF HIGHWAY 35E AT TEASLEY NE, AS SHOWN ON THE OFFICIAL CITY MAP OF THE CITY OF NTON, TEXAS~ AND MORE PARTICULARLY DESCRIBED HEREIN, pROVIDING CERTAIN RESTRICTIONS, AND DECLARING AN EFFECTIVE DATE HE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ECTION It That the Zoning Map of the City of Denton, Texas~ 1961, adopted as a part of Parts II and III of Chapter 13 of the Code of Ordinances of the City of Denton, Texas, under the p~ovlslons of Ordinance No 61-19 be, and the same is hereby amended as follows 11 hereinafter described property zs hereby of the ~emoved from the "R"-Dwelllng D~strmct as shown on ~a~d map, and all provlslonsof Parts II and III of ~hapter 13 of the Code of Ordinances of the Czty of Denton, Texas, as provided by Ordinance No 61-19, shall ~ereafter apply to sazd property as "LB"-Local Business blstrlct in the manner as other property located in the "LB"- Local Business Dlstrzct, provided, however, that any building erected on the below descrzbed prop- rty is to be set back a mlnzmum of one-hundred (100) ~eet from the property line ad]oln~ng U S Interstate Ilghway 35E, and no building constructed thereon shall e constructed of corrugated steel other than the roof ~hlch should be tinted for appearance sake iThe validity of this entzre ordinance depends and ls ~ased on the validity of thzs set-back and no steel isldlng provision, said provisions being a reasonable exercise of the Police powers of the Czty of Denton, Texas Ail that certain lot, tract or parcel of land situated ~n the C~ty and County of Denton, Texas, located on the North- east corner from U.S Interstate H~ghway 35E at Teasley Lane, from sa~d corner north 137 feet on the East s~de of Teasley Lane, THENCE East 892 feet to property owned by HOl~dy Inn, THENCE South 445 feet to Access Road, THENCE West along H~ghway 35E for 955 feet to Place of Beginning SECTION II The C~ty Council of the C~ty of Denton, Texas, hereby f~nds that such change is ~n accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, and with reasonable consideration, among other th~ngs, for the character of the district for its pecuDar sultablllty for particular uses and w~th a v~ew to conserving the value of buildings and encouraglng the most appropriate use of such land for the maxlmum benefit to the C~ty of Denton, Texas, and its c~tlzens SECTION III That th~s ordlnance shall be in full force and effect ~mmedlately after ~ts passage and approval, the re- quired publlc hearings having heretofore been held b~)the Planning and Zoning Commission and the C~ty Council ///_/----.// ~dayof PASSED AND APPROVED th~s · , A D 1964 Warren Wh~tson, Jr , Mayor C~ty of Denton~ Texas ATTEST Bro~ Holt, City Secretary C~ of Denton, Texas APPROVED AS TO LEC4~L FORM tyQ Barton~ C~ty Attorney of Denton, Texas
