SECTION 2 That each of said street units shall be paved with
the following type of pavement
2" hot mix asphaltic concrete pavement on a
6" crushed stone base
Streets shall be paved from curb to curb, "Roll Type" curbs
and gutters shall be constructed where the City Engineer of the City
of Denton determines that adequate curbs and gutters do not exist
and necessary drainage facilities shall be installed The speci£i-
cations for all such improvements, heretofore prepared by the Department
of Engineering of the City of Denton, and now on file with the City
Council are hereby in all things approved
SE�TION 3 The City Manager is hereby authorized and directed
to advertise for bids £or the improvement work herein described
The advertising, receiving and opening of such bids to be as pro-
vided by the Charter of the City of Denton and the laws of the
State of Texas
Upon the receipt and opening of the bids for
such improvement work, the City Engineer of the City of Denton is
hereby directed to prepare and file with the City Council his
estimate of the total costs of the improvements herein ordered, and
the total amount of the costs thereof to be paid by the City of
Denton and by the abutting properties and the owners thereof in
accordance with the provisions of Section 5 hereof and the instYUCtions
which may be given him by the City Council
SE�TION 4 The City Council of the City of Denton deems it
advisable and hereby determines to proceed under and in the
exercise in the powers, terms and provisions of Chapter 106, Acts
of the First Called Session of the 40th Legislature of Texas, (being
Art 1105b R C S) and the provisions of the Charter of the City
of Denton
SECTTON 5 The costs o£ said improvements shall be paid as
£ollows, to wit
(a) The City of Denton shall pay all of the cost of drainage
installations where�er located, all of the cost of ex-
cavation, base preparation, base and surfacing within
street and alley intersections, th2rty-three and one-
thlyd percent (33 1/3°�) of the Cost of excavation, base
preparation, base and paving of a street surface thirty
fe�t in width, and one hundred percent (100%) of the
cost of excavation, base preparation, base and surfacing
for the excess width m�e�8ei$9 any street surface over
thirty feet in width where said excess width is deemed
b� the City Engineer of the City o£ Denton to adequately
handle present and future traffic needs
(b) The remainder of the costs of such improvements shall be
assessed against the respective abutting properties
and the real and true owners thereof in accordance with
the City Charter and the Statutes of Texas�i� ein re-

ferred to Such assessments shall be made according to
the "Front-Foot Rule", in proportion as the frontage
of each parcel of property is to the whole frontage
improved, unlesa the application of such rule would,
in the opinion of the City Council, in particular cases,
result in in7ustice or inequality, in which cases the
City Council shall apportion and assess such costs in
such proportions as it may deem 7ust and equitable,
having in view the special benefits in enhanced value
to be received by such parcels of property and the
owners thereof, the equities of such owners, and the
ad�ustment of such apportionment so as to produce a
substantial equality of benefits received and burdens
impoaed No assessment shall be made against any
abwtting property or the real and true owners thereof
for costs in excess of the benefits to such property
in enhanced value thereof by meana of such improvements
(c) The Several sums above mentioned and assessed against
said parcels of property and the owners thereof and
interest thereon at the rate o£ eight per centum (8�)
per annum on the initially deferred balance, together
with reasonable attorneys' fees and costs of collections
if incurred, are hereby declared to be and are made �
lien upon the respective parcels of property against
which the same are assessed, and a personal liability
and charge against the real and true owners of such
I property, whether such owner be named herein or not, and
the said liens shall be and constitute the first en-
forceable lien and claim against the property on which such
aseessments are levied, and shall be a first and paramount
lien thereon, superior to all other liens and claims
except state, eounty, achool district and city ad valorem taxes
(d) (1) The sums so assessed against the abutting property
and the owners thereof, shall become due and pay-
able as £ollows, to wit, in thirty-six (36) equal
install�ents, the firet payable on or before thirty
(30) days from the completion and acceptance of
the improvements of the Unit upon which the property
abuts, and one (1) each month therea£ter until the
total amount is paid, deferred payments shall bear
interest from the date of such completion and
acceptance at the rate of eight per centum (8%)
per annum on the initially deferred balance, payable
monthly with each installment, so that upon the comple-
tion and acceptance of the improvements in a particular
Unit, assessments against such completed and accepted
Unit shall becomE due and payable in such installments,
and with interest from the date of such completion and
acceptance
(2) Provided, however, that any owner shall have the right
to pay the entire assessment, or any installment thereof,
before maturity, by payment of principal and accrued
interest, and further provided that if default shall be
made in the payment oP any installment of principal or
interest promptly as same matures, then the entire amount
of the assessment upon which such default is made shall,
at the option of �he City of Denton, or its assigns, be
and become immediately due and payable, and shall be
collectable, together with reasonable attorneys' feea and
costs of collection, in incurred
(e) The assessed portion of the cost of such improvements may be
further secured by Mechanic's Liens to be executed in favor
oE the City of Denton, but Certificates of Special Assessment
shall be issued in favor of the City of Denton, whether
the owners have executed such Mechanic's Liens or not
(f) The City of Denton shall pay for the aforesaid work
on the various Street Units on monthly estimates as
the work progresaes, ten percent (10�e) of the amount
due by the City of Denton on each such estimate being
retained by the C2ty until completion and acceptance
o£ the work involved in the Street Unit on which the
estimates are swbmitted
SE�TION 6 The construction and installation of the improve-
ments h�rein ordered in each Street Unit herein designated and
describ�d shall be separate and independent o£ the construction and
install�tion of such improvements in each and every other 5treet
Unit The asaessmente to be levied for the improvements in each
Street Uriit �hall be sep�rate and distinct from the assessments to
be levied in every other Street Unit and in making and levying
assessments against property for the improvements in one Unit, no
material or substance in connection with any other Unit shall be
considered, all as fully and to the same extent as if separate
contracta were executed and separate proceedings had with reference
to each such Street Unit or portion of street
SECTION 7 The City Secretary is hereby directed to cause
to be prepared a Notice of Enactment of this ordinance and to file
said Natice with the Countp Clerk of Denton County, Texas, in the
Deed of Trust Records o£ DAnton County, Texas
S�F.CTION 8 This ordinance shall be effective immediately
upon itrs passage, and ratifys all preceeding actions, bids and
notices pertinent hereto

Myrtle Street (from .Eagle Drive to Maple Street), in the City of
Denton, Texas, in the manner and according to the plans and
specifications therefore, which plans and specifications have
heretofore been approved and adopted by said City Council; and

Denton, Texas, of the enactment of the said above described
ordinance has heretofore on the 9th day of June, 1964, been
filed in the Deed Records of Denton County, Texas, in Volume
509, Page 382; and
WIiEREAS, the City Council of the City of Denton, Texas, by
Ordinance No. 64-26, dulty enacted on the 26th day of May, 1964,
declared the liability of the adjacent property owners for a
portion of the cost of improving the said portion of Myrtle

Eight Cents ($412.08); and
WHEREAS, the property owner's share of the cost of improving

Denton is Four Hundred and Twelve Dollars and Eight Cents

In consideration of the payment by the said B. M. Kennedy,
et al, Trustees of the Pentecostal Holliness Church of Denton to
the City of Denton, Texas of Four Hundred and Twelve Dollars and
Eight Cents ($412.08) receipt of which is hereby acknowledged,
the said City of Denton, Texas, does hereby forever release and
discharge the said B. M. Rennedy, et al, Trustees of the

RELEASE OF PAVING LIENS
ASSESSED AGAINST HOMESTEADS
BY ORDINANCE NO. 64-26

WHEREAS, the City Counci] of the City of Denton, Texas, has heretofore by
Ordinance No. 64-26 duly enacted on May 26, 1964, determined the necessity for and ordered
the improvement of vazious streets in the City of Denton, Texas, in the manner and according
to the plans and specifications therefore, which plans and specifications have heretofore been
__approved and adopted by the said City Council; and
WHEREAS, a notice duly executed in the name of the City of Denton, Texas, of the
enactment of the said above described ordinance has heretofore on June 9, 1964, been filed in
the Deed Records of Denton County, Texas, in Volume 509, Page 382; and
WHEREAS, a portion of the properties abutting the vazious streets described in
Ordinance No. 64-26 were claimed as homestead at the time the improvements were ordered;
and
WHEREAS, attached hereto as Exhibit "A" and incorporated herein as if set forth at
length is a list of those properties which were claimed as homestead, according to Denton
County taac records, at the time the improvements were ordered and for which no mechanids
lien contract was executed; and
WHEREAS, pursuant to Article 16 Section 50 of the Texas Constitution, a lien
declazed upon abutting property is void if the proper[y was claimed as a homestead at the
time the improvements were ordered and no mechanids ]ien contract was executed by the
owner prior to the work being performed; NOW, THEREFORE,
--The.City_of.Denton, Texas,_does herebv and_herewith forever release theproperties
described in Exhibit "A" from any and all special assessment liens and claims arising by
virtue of the improvements described in the aforesaid ordinance by the City Council of said
City, in the aforesaid notice recorded in Volume 509, Page 382 of the Deed Records of
Denton County, Texas.
The personal liability of the owner of the property which is the subject of the
assessment at the time the improvements were ordered is expressly reserved by the City of
Denton and is not herewith released or dischazged.

NOTICE OF ASSESSMENT

KNOW ALL MEN BY THESE PRESENTS:
That the duly elected and constituted City Council of the
City of Denton, Texas, adopted an Ordinance on the 26th day of
May, A. D. 1964, declaring the necessity for and ordering the
paving and improvement of certain portions of those streets in
the City of Denton therein listed and of record in Volume 509,
Page 382 of �he Deed Records of Denton County, Texas, to which
instrument reference is here made for all purposes, ,
Said Ordinance further provided for a portion of the cost
of said improvemen-ts to be specially assessed as a lien upon pro-
perty abu�t�ting the streets improved and as a personal liability
against the owners of such abu-tting property, such assessments to
be payable to the City of Denton, Texas.
Further, said City Council, after giving proper notice as re-
quired by law, held a public hearing concerning said assessment
program on June 2, 1964, after which the hearing was closed and the
amount of $1.35 was set by said Council pursuant to the Ordinance
of Assessment passed May 26, 1964 (Ordinance No. 64-26) for curb
and gu�tter improvements, and $2.69 for paving improvements.
That pursuant to the action of said Council the following
attached e�ibit is made a part of and augments Ordinance No. 64-26
referred to above as it enumerates and completes said Ordinance of
Assessmen� as to the amounts and figures contained therein for each
property owner.
WHEREFORE, the City of Denton, Texas, acting by and through
its City Council has caused this Notice to be signed by the City
Secretary in the name of the City of Denton and to have the official
,-Sea1 of the City of Den-ton affixed hereto this the llth day of
