1964-007 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF DENTON, TEXAS, PROVIDING FOR ALLEYS, AND FOR
OVER-HANG EASEMENTS THEREFROM, PROVIDING ADDITIONAL
GUY WIRE EASEMENTS FOR NON-STRAIGHT ALLEYS, REPEALING
CONFLICTING ORDINANCES, PROVIDING A SAVINGS CLAUSE,
AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION ,I
That the Code of Ordinances of the City of Denton, Texas,
is hereby amended by substituting new Subsection (h) of
Article 13 09 in Chapter Thirteen of said Code of Ordinances
which shall hereafter read as follows
13 09 (h) Alleys in Business and Residential Areas
(1) Alleys or loading courts of a
minimum width of twenty feet (20')
paved surfaoe or, in lieu thereof,
adequate offstreet loading space,
shall be provided in business
blooks, Alleys are not required
in residential districts, except
that same shall be provided
where alleys or adjacent subdivi-
sions already platted would be
closed or dead-ended by failure
to provide alleys in the new
subdivisIon
(2) Alleys shall be constructed in
accordance with the City of Denton
specifications for same, which are
on file in the office of the City
Secretary and made a part hereof
by reference
(3) In all alleys over-hang easements
for electric and telephone lines
of at least f~ve feet (5') on
each side of the alley strip at
a height at or above eighteen
feet (18') shall be provided
(4) If the alleys are not themselves
straight within each block, or if
the same do not connect on a
straight course with the alleys
of adjoining blocks, then an
easement shall be provided for the
placang of guy wares on lot davzsaon
lanes an order to support poles
set on eurvang or devaatang
raghts-of-way or alleys
(5) Dead-end alleys shall not be permatted
SECTION II
That all ordanances or parts of ordanances an force when the
provasaons of thas ordanance become effective whach are anconsastent
or an conflact wath the terms or provzsaons contaaned an this
ordanance are hereby repealed to the extent of any such conflact
SECTION III
That af any sectaon, subsection, paragraph, sentence, clause,
phrase or word an thas Ordanance, or appl~cataon thereof to any
person or carcumstances as held anvalad by any court of competent
jurlsd~ctlon, such holdang shall not affect the validity of the
remaanang portaons of thas Ordanance, and the Caty Counc~] of the
Czty of Denton, Texas, hereby declares at would have enacted such
remaanang portlons despite any such ~nval~daty
SECTION IV
That thzs Ordanance shall become effectzve fourteen (14)
days from the date of zts passage, and the Caty Secretary
is hereby dareeted to cause the captaon of thas Ordanance to be
publashed twlce an the Denton Record Chronacle wzthan ten (10)
days of the date of ars passage~~~
