1964-002 AN ORDINANCE A/4ENDING THE ZONING MAP OF THE CITY
OF iDENTON~ TEXAS, 1961, AS SAME WAS ADOPTED AS A PART
OF PARTS II AND III OF CHAPTER 13 OF THE CODE OF ORDI-
NANCES OF THE CITY OF DENTON, TEXAS, BY CIR~..~NANCE NO,,..~ ~J~-~
AS i SHOWN ON THE OFFICIAL CITY MAP OF THE CITY OF DENTON,--
TEXAS~ AND MORE PARTICULARLY DESCRIBED HEREIN, AND
DECLARING AN EFPECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the Zoning Map of the City of Denton,
Texas, 1961, adopted as a part of Parts II and III of Chapter 13
of the Code of Ordinances of the City of Denton, Texas, under the
provlslons of Ordinance No 61-19 be, and the same is hereby
amended as follows
All of the hereinafter described property ~s hereby
removed from the "R" - Dwelling District as shown on
sa~d map, and all provisIons of Parts II and III of
Chapter 13 of the Code of Ordinances of the City of
Denton, Texas, as provlded by Ordinance No 61-19,
shall hereafter apply to said property as "LB" - Local
Business District property in the same manner as other
property located ~n the "LB" - Local Business District,
provided, however, that any building constructed on the
below described property is to be set back 170 feet from
the boundary line abutting University Dr~ve West, the
front building line on such property to parallel
University Drive West and to be 170 feet from said
boundary line abutting said University Drive West
The validity of this entire ordinance depends and is based
on the valldzty of this set-back provzs~on, sa~d provas~on
bezng a reasonable exercase of the polace powers of the Caty
of Denton, Texas
All that certaan lot, tract or parcel of land situated an
the City and County of Denton, Texas, and beang more
partacularly desorabed as follows
A part of Lot 3 Block 4071 in the Robert Beaumont Survey
No 31, an the Caty of Denton, Texas, located on the North
sade of Unaverszty Dr~ve West, abuttang 234 feet on
Universaty Drive West, and having a depth of 550 feet
North from said University Dr~ve West, saad property
ad]olnang that owned by Dr D B Whatehe~d, as recorded
and further descrabed ~n the deed records of Denton County,
Texas
SECTION 2 The Caty Council of the Caty of Denton, Texas,
hereby fznds that such change as an accordance w~th a comprehensave
plan for the purpose of promoting the general welfare of the C~ty
of Denton, and wlth reasonable cons~derataon, among other thangs,
for the character of the dlstr~ct and for ~ts peculiar suztabalaty
for partzcular uses, and wzth a view to conservang the value of
bualdlngs and encouraging the most approprzate use of such land
for the maxzmum benefat to the Czty of Denton, Texas, and ats
cltlzens
SECTION 3 That thas Ordinance shall be in full force and
effect zmmedzately after ~ts passage and approval, the requared
public hearings havang /heretofore been held by the Planning and
Zonang Commzssaon and the Caty Counczl
