1965-047 AN ORDINANCE AMENDING THE CODE OF ORDINANCE OF THE CITY OF DENTON, TEXAS, DEFINING CERTAIN GEN- ERAL REQUIREMENTS FOR UNDERGROUND ELECTRICAL UTILITIES, REPEALING CONFLICTING ORDINANCES, PRO- VIDING A SAVINGS CLAUSE, AND DECLARING AN EFFEC- TIVE DATE THE COUNCIL OF TPE CITY OF DENTON HEREBY ORDAINS ,SECTION I That the Code of Ordinances of the Czty of Denton, Texas hereby ammnded by addzng new articles to Chapter Seventeen of sazd Code of Ordznanoes which shall herea~fter read as follows Artlcle 17 32 - Low Vqltaqe Installatlons (h) The City of Denton, Department of Public Ut~lmt~es, wzll mnstall or cause to be mnstalled w~thout charge the underground service connection from the trans- former pole structure, transformer pad mount, or secondary termlnatxon pedestal, not to exceed 150 feet for any all-electric residence An all-electric resxdence shall be classlfmed as one which utmlmzes only electricity for general purpos~ heatmng, water heatmng, cooling, cooklng, etc (i) The City of Denton, Deaprtment of Public utllltles, wxll install or cause to be mnstalled, an the front yard of an all-electric residence, an underground served~ photo-cell operated yard l~ght Th~s instal- lation will be made at no charge to the owner of the reszdence An all-electr~c residence shall be class- ~fled as one which utilizes only electricity for general purpose heatmng, wa~er heatzng, coolzng, cook- lng, etc Article 17 35 - Underqround Street Llqhtzng (g) The City of Denton shall share in the installation cost, in the amount of One Hundred Dollars ($100 00) per llghtlng standard in the underground ~nstallatlon of street lxghtlng as installed by the Developer The required number and locatzon of street lights shall be determined by the City of Denton In the event that a h~gher level of Illumination is requzred (m e for intersections or h~gh densxty traffic areas) the C~ty of Denton wall bear the additional cost ~ncurred in the required larger fmxture and ballast over and above the standard 250 Watt Mercury Vapor F~xture -1- .SECTION II. That all ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions con- talned in this ordinance are hereby repealed to the extent of any such conflict SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application there- of tO any person or circumstances l~ held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such invalidity SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronicle within ten (10) days from the date of its passage PASSED AND APPROVED this ~ day of ~~. , A D 1965 Warren Whltson, Jr , Mayor C~ty of Denton, Texas ATTEST APPROVED AS TO LEGAL FORM ~k Q Barton, City Attorn y /~lty of Denton, Texas -2-
