1965-038 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY
OF DENTON, TEXAS, 1961, AS SAME WAS ADOPTED AS
A PART OF PARTS II AND III OF CHAPTER 13 OF THE
CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS,
BY ORDINANCE NO. 61-19, AND AS SAID MAP APPLIES
TO CERTAIN PROPERTY KNOWN AS LOTS 1, 2, 3, 4
AND 5, BLOCK A, JOHN ROADY SUB-DIVISION, AN
ADDITION TO THE CITY OF DENTON, TEXAS, AND MORE
PARTICALLY DESCRIBED HEREIN, PROVIDING CERTAIN
CONDITIONS AND RESTRICTIONS, AND DECLARING AN
EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY
ORDAINS
SECTION I
That the Zoning Map of the City of Denton, Texas, 1961,
adopted as a part of the Parts II and III of Chapter 13 of
the Code of Ordinances of the City of Denton, Texas, under
the provls~ons of Ordinance No 61-19 be, and the same is
hereby amended as follows
Ail of the hereinafter described property is hereby re-
moved from the "R" - Dwelling District as shown on said
map, and all provisions of Parts II and III of Chapter
13 of the Code of Ordinances of the City of Denton, Texas,
as provided by Ordinance No 61-19, shall hereafter apply
to sa~d property as "A-2" Dwelling D~strlct ~n the same
manner as other property located in the "A-2" - Dwelling
D~strlct provided, however, as a condition to the enact-
ment of this ordinance, all construction in th~s below
described property Ks l~mlted to the erection of s~ngle
family row houses, of the type as presented by John Roady
to this City Council on the 28th day of September, 1965,
and no Certificate of Occupancy will be issued prior to
the fulfillment of this condition, and the validity of
this entire ordinance depends and ~s based upon the
validity of th~s cond~tlon, th~s condition being a reason-
able exercise of the police powers of the C~ty of Denton,
Texas, said property being described as
Ail that certaan property situated an the Caty and
County of Denton, Texas, known as Lots 1, 2, 3, 4 and
5, Block A, of the John Ready sub-davasaon to the Caty
of Denton, Texas, the same beang situated an Caty Block
4049A as shown on the offacaal caty map of the City of
Denton, Texas, the same beang located East of Malone
Street and South of Unaversaty Dr~ve
SECTION II.
That the City Councal of the C~ty of Denton, Texas, hereby
fands that such change and cond~taon as ~n accordance wath a
comprehensive plan for the purpose of promotang the general
welfare of the Caty of Denton, and wath reasonable consideration,
among other things, for the character of the distract and for
ats peculaar su~tabllaty or particular uses, and w~th a vaew
to conserving the value of bualdlngs, protecting human l~ves,
and encouraging the most appropriate uses of land for the maxa-
mum benefit to the Caty of Denton and ~ts c~t~zens
SECTION III
That thas ordinance shall be zn full force and effect
lmmedaately after ~ts passage and approval, the requared publzc
hearangs havang heretofore been held by the Planning and Zoning
Commassaon and the Caty Council, after giving due notice thereof
