1965-036 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF DENTON, TESS, AUTHORIZING THE CHIEF OF POLICE TO
SUSPEND THE OPERATION OF ANY PARKING METER FOR CERTAIN
PURPOSES, REQUIRING A FEE FOR THE TEMPORARY SUSPENSION
OF ANY SUCH METER, PROVIDING AN ANNUAL FEE FOR THE USE
OF A LOADING ZONE BY THE ABUTTING OWNER OR OWNERS RE-
SERVING SAME, PROVIDING A SAVINGS CLAUSE, AND DECLARING
AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION !-
That the Code of ordxnances of the City of Denton, Texas,
ms hereby amended by mncludlng new Articles 16.23 (a) (3),
16.23 (b) (1) & (2), 16.29 (h) (3) & (4) an Chapter S~xteen
of sald Code of Ordinances which shall hereafter read as follows
ARTICLE 16.23 - LOADING ZONES
(a) Persons Entitled to Loading Zones
(3) No loading zone will be considered necessary for
the conduct of any buslness unless such zone ms
used on a regular basls for loadlng, supplying
or maintaining such business by non-customers
thereof.
(b) Fees
(1) For one car parking space (whether d~agonal or
parallel parking is required) the sum of Fmfty
Dollars ($50.00) per annum.
(2) Where more than one car parkmng space is essen-
tial to the conduct of sazd busxness, an addm-
tlonal amount of F1ve Dollars ($5.00) per foot
per annum shall be charged for such space.
ARTICLE 16.29 - PARKING METER REGULATIONS AND ZONES
(b) Installation and Maintenance of Parklng Meters -
Marking Spaces - Suspending Operation
(3) The Chief of Police shall have the authormty to
suspend the operation of any parkxng meter when,
such suspension ms necessary for constructing,
re-constructxng, maznta~nzng or servxcmng an
abuttzng structure on a temporary basms.
(4) A fee of Fifty Cents ($°50) per day shall be
charged to the person requiring the temporary
suspension of a parking meter for each day such
suspended meter would otherwise be in operation°
SECTION
That all ordinances or parts of ordznances in force when
the provisions of thzs ordinance become effective which are
~nconslstent or in conflict with the terms or provlsmons con-
talned in this ordinance are hereby repealed to the extent of
any such confllcto
SECTION III.
That if any section, subsectzon~ paragraph~ sentence,
clause, phrase or word in th~s ordinance, or applzcatlon
thereof to any person or c~rcumstances is held lnvalzd by any
court of competent ]urlsdmct~on, such holding shall not affect
the validity of the remaining port~ons of thzs ordznance, and
the City Council of the Clty of Denton, Texas, hereby declares
it would have enacted such remaining portmons despite any such
~nvalldlty.
SECTION IV.
That this ordinance shall become effective on and after
January 1, 1966, and the C~ty Secretary ~s hereby d~rected to
cause the caption of this ordinance to be published twice in
the Denton Record Chronicle within ten (10) days of the date
of ~ts passageo ~ ~, .
