1965-034 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF
DENTON, TEXAS, 1961, AS SAME WAS ADOPTED AS A PART OF
PARTS II AND III OF CHAPTER 13 OF THE CODE OF ORDIN-
ANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO.
61-19, AND AS SAID MAP APPLIES TO CERTAIN PROPERTY
KNOWN AS CITY LOTS 12, 13, 14, 15, 21 AND THE SOUTH
PART OF LOT 22 OF CITY BLOCK 413, AS SHOWN ON THE
OFFICIAL CITY MAP OF THE CITY OF DENTON, TEXAS, AND
MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING CERTAIN
ICONDITIONS AND RESTRICTIONS, AND DECLARING AN EFFEC-
TIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I.
That the Zoning Map of the City of Denton, Texas, 1961,
adopted as a part of Parts II and III of Chapter 13 of the
Code of Ordinances of the City of Denton, Texas, under the
provlszons of Ordinance No 61-19 be, and the same is hereby
amended as follows
All of the hereinafter described property 1s hereby
removed from the "R" - Dwelling Dlstr~ct as shown on
said ~, and all provisions of Parts II and III of
Chapter 13 of the Code of Ordinances of the C~ty of
Denton, Texas, as provided by Ordinance No 61-19,
shall hereafter apply to sald property as "L-R" -
Local Retail D~str~ct ~n the same manner as other
property located 1n the "L-R" - Local Retail D~strlct,
provided, however, as a condition to the enactment of
this ordlnance, a masonry fence shall be constructed
along the north boundary l~ne of Sherman Dr~ve exten-
slon to screen the property north thereof from the
v~ew of other construction on the property described
above, which masonry fence shall be of sufficient and
adequate height, and shall be constructed prior to the
issuance of any Certificate of Occupancy involving the
property described below, and the validity of th~s
entire ordinance depends and ~s based upon the valad~ty
of thls provlsaon, th~s prov~s~on beang a reasonable
exercise of the police powers of the Caty of Denton,
Texas
Ail that certain property s~tuated ~n the C~ty of Denton,
Texas, known as C~ty Lots No 12, 13, 14, 15, 21 and the
south part of Lot 22, of C~ty Block 413, as shown on the
offlclal Clty map of the Clty of Denton, Texas, which
property laes between North Locust Street and North Elm
Street, North of Unlversaty Drlve, the north boundary lane
thereof running along the South r~ght-of-way of the pro-
posed new street extending Sherman Dr~ve to North Elm
Street
SECTION II.
That the C~ty Council of the C~ty of Denton, Texas, hereby
f~nds that such change and condlt~on ~s an accordance w~th a
comprehensave plan for the purpose of promoting the general
welfare of the City of Denton, and w~th reasonable considera-
tion, among other thlngs, for the character of the d~str~ct and
for its peculiar suitability or particular uses, and with a
v~ew to conservlng the value of bu~ldangs, proteetlng human
l~ves, and encouragang the most appropriate uses of land for
the maximum benefit to the C~ty of Denton and lts c~tlzens
SECTION III.
That thzs ordznance shall be an full force and effect
~mmed~ately after zts passage and approval, the requzred publzc
hearings hav~ng heretofore been held by the Planning and Zonang
Commission and the Caty Councal, after gavzng due not~ce thereof
