1965-030 AN ORDINANCE AMENDING THE CODE OF ORDIk~NCES OF THE CITY OF DENTON, TE~%S, DEFINING THE SCOPE AND CERTAIN OTHER GENERAL REQUIREMENTS FOR UNDERGROUND ELECTRICAL UTILITIES, PROHIBITING DECORATIVE TYPE STREET LIGHTING WITHIN RESIDENTIAL AREAS AND OTHER INSTALLATIONS, REPEALING CONFLICTING ORDINANCES, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY oRDAINS That the Code of Ordinances of the C~ty of Denton, Texas, is hereby amended by adding new Articles 17 29, 17 32 and 17 35 to Chapter Seventeen of sa~d Code of Ordinances which shall hereafter read as follows Article 17 29 - General Requ~rement, s (c) Scope The scope of th~s ordinance ~s to cover all portlons of the electrical ~nstallataon from the point of attachment at the entrance of the high tension cable from the Municipal Facilities through fusing, switching, transformation, cable service through to and ~ncludlng the maan entrance swatch attached to the consuming unit The scope of this ordinance as to also cover any conduits for yard lights, decorative laghting, underground outbuilding service or control and/or any underground electrlcal wiring used for illumination, motors, heating or other types of electrical consuming unit Article 17 32 - Low Voltaqe Installations, (g) The use of type U F, R R or other types of Direct Burial cable as prohibited All underground electrical conductors must be encased in a protective conduit with a maximum f~ll of forty (40) percent Article 17 35 - Underqround Street Llqhtlnq (d) Deceratlve type street lighting w~ll not be permitted w~thln residential areas Mercury vapor lighting shall be used for all street l~ghtlng installations, utilizing a minimum 250 watt mercury vapor lamp SECTION II That all ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are anconsls- tent or in conflict with the terms or provisions contained an this ordinance are hereby repealed to the extent of any such conflict That ~f any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or c~rcumstances Ks held ~nval~d by any court of competent 3ur~sd~ct~on, such holding shall not affect the validity of the remalnlng portlonsof th~s ordinance, and the City Council of the C~ty of Denton, Texas, hereby declares it would have enacted such rema~nlgn port~ons despite any such ~nvalld~ty That th~s ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the City Secretary ~s hereby d~rected to cause the caption of this ordinance to be published twice in the Denton Record Chronicle w~th~n ten (10) days from the date of its passage. ~~l PASSED AND APPROVED this /__~ day of ~ ..., A D 1965 Warren Wh~tson, Jr , Mayor C~ty of Denton, Texas ATTESts% ~ ~o~s Holt, City Sect Y %/C~ty of Denton, Texas APPR~D AS TO LEGAL FORM j~ Q Barton, City Attorney ty of Denton, Texas CITY OF DENTON PA~ING ASSESSMENT i ~EXHIBIT "A" EXTENT OF SSREET ESTIMATED COST TOTAL ESTIMATED  PER FRONT FOOT COST University Drive $7 00 $69,027 00 from the east right-of- way of Locust Street to the west r~ght-of- way of Malone Street C~ty Secretary City of Denton, Texas ____/
