OF PARTS II AND III OF CHAPTER THIRTEEN OF THE CODE
OF ORDINANCES OF THE CITY OF DENTON, TEXASe BY
ORDINANCE NO. 61-19, AND AS SAID MAP APPLIES TO
CERTAIN PROPERTYe BEING PORTIONS OF CITY BLOCK 3029
AND CITY BLOCK 3030e AS SHOWN ON THE OFFICIAL CITY
MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTIC-
ULARLY DESCRIBED HEREIN, PROVIDING CERTAIN CONDITIONS
AND RESTRICTIONS, AND DECLARING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I.
That the Zoning Map of the City of Denton, Texas, 1961e
adopted as a part of Parts II and III of Chapter 13 of the
Code of Ordinances of the City of Denton, Texas, under the
provisions of Ordinance No. 61-19 be, and the same is hereby
amended as follows
Ail of the heremnafter described property zs hereby
removed from the "R" - Dwelling Dlstr~ct as shown on
sa~d mape and all provisions of Parts II and III of
Chapter 13 of the Code of Ordinances of the C~ty of
Dentone Texas~ as provzded by Ordinance NOo 61-19, shall
hereafter apply to samd property as "A-2" - Dwelling
Dzstrlct zn the same manner as other property located
in the "A-2" - Dwelling D~strlct, provided, however~
that any building or structure erected on the below
described property is to be set back a m~n~mum of thirty
(30) feet from the present right-of-way line of Bonnie
Brae Street which abutts th~s descrzbed property. It is
understoode however, that thzs thirty foot str~p abutting
sazd Bonnie Brae Street right-of-way may be ~ncluded in
the off-street parking requirements relating to said
propertye and may be used for a driveway and access
purposes.
The validity of this entire ordinance depends and is
based on the validity of this set-back provision, samd
provlszon being a reasonable exercmse of the police powers
of the City of Denton, Texas
Ail that certain property situated in the City of Denton,
Texase known as City Lots 1 through 9, of City Block
3030, and City Lots 10 through 1~, of City Block 3029.
Thls property Ks located on West Prairie Street between
Avenue H and Bonnie Brae Streets°
,SECTION II.
The C~ty Council of the City of Denton, Texas, hereby finds
that such change and condition is in accordance with a compre-
hensive plan for the purpose of promoting the general welfare of
the City of Dentone Texas, and wzth reasonable consideration,
among other thmngse for the character of the district and for
1ts peculiar suitability or particular uses, and wzth a view to
conserving the value of buildings and encouraging the most
appropriate uses of land for the maximum benefit to the City of
Denton, Texas, and its citizens.
SECTION III.
That this ordinance shall be in full force and effect
Immediately after its passage and approval, the required public
hearings having heretofore been held by the Planning and Zoning
Commlsslon and the City Council.
