1965-019 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF
DENTON, TEXAS, 1961. AS SAME WAS ADOPTED AS A PART
OF PARTS II AND III OF CHAPTER THIRTEEN OF THE CODE
OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY
ORDINANCE NO. 61-19, AND AS SAID MAP APPLIES TO
CERTAIN PROPERTY LOCATED AT THE CORNER OF SANGER
ROAD AND BUSINESS ROUTE UoS. HIGHWAY 77, BEING PART
OF ABSTPACT ~186 IN THE CITY OF DENTON, TEXAS, AS
SHOWN ON THE OFFICIAL CITY MAP OF THE CITY OF DENTON,
TEXAS~ AND MORE PARTICUIARLY DESCRIBED HEREIN,
PROVIDING CERTAIN CONDITIONS AND RESTRICTIONS, AND
DECLARING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I.
That the Zoning Map of the City of Denton, Texas, 1961,
adopted as a part of Parts II and III of Chgpter 13 of the
Code of Ordinances of the City of Denton, Texas, under the
provisions of Ordinance NOo 61-19 be, and the same is hereby
amended as follows
Ail of the hereinafter described property is hereby
removed from the "R" - Dwelling District as shown on
said map~ and all provisions of Parts II and III of
Chapter 13 of the Code of Ordinances of the City of
Denton, Texas, as provided by Ordinance NOo 61-19, shall
hereafter apply to said property as "A-2" - Dwelling
District in the same manner as other property located
in the "A-2" - Dwelling District, provided, however,
that curb and gutter shall be constructed on Sanger Road
fronting said property, and also on Business Route U.S.
Highway 77, as a condition precedent to any construction
on this property, and that adequate right-of-way shall
be dedicated for street purposes abutting this below
described property; and that all structures or buildings
erected on this property shall be set back fo.-five
1(45) feet from the center line of Sanger Road.
The validity of thls entire ordinance depends and ls
based on the validity of th~s set-back provls~on, sa~d
prov~s~on being a reasonable exercise of the police
powers of the C~ty of Denton, Texas
Ail that certan property s~tuated in the C~ty of Denton,
Texas, located South of U.S. Hlghway 77 Bus~ness Route
and North of Sanger Road, sa~d property comes to a point
at the intersection of H~ghway 77 Bus~ness Route and
Sanger Road, fronting H~ghway 77 Bus~ness Route 693 feet,
and running 597 feet on Sanger Road, the West side of
thls property ~s 347 feet w~de, containing 2.4 acres
more or less.
SECTION II.
The Czty Council of the Cmty of Denton, Texas, hereby f~nds
that such change and condition ~s ~n accordance with a compre-
hensive plan for the purpose of promoting the general welfare
of the Czty of Denton, and wmth reasonable consideration, among
other things, for the character of the d~strlct and for
peculiar suitabll~ty or particular uses, and with a v~ew to con-
serving the value of buildings and encouraging the most appropriate
uses of land for the maximum benefit to the City of Denton,
Texa$e and mts cmt~zens.
SECTION III.
That this ordinance shall be in full force and effect
immediately after 1ts passage and approval, the required publzc
hearings having heretofore been held by the Planning and Zoning
Cor~n~ss~on and the City Council.
