1965-020 NO. DENTON~ TEXAS, 1961, AS SAME WAS ADOPTED AS A PART OF PARTS II AND III OF CHAPTER THIRTEEN OF THE CODE OF ORDIHANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO. 61-19, AND AS SAID MAP APPLIES TO CERTAIN PROPERTY LOCATED AT THE NORTHWEST CORNER OF EAGLE DRIVE AND I.O.OoF. STREET~ BEING A PORTION OF CITY BLOCK 334, AS SHOWN ON THE OFFICIAL CITY MAP OF THE CITY OF DENTON, TEX~S~ AND MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING CERTAIN CONDITIONS AND RESTRICTIONS, AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I. That the Zoning Map of the City of Denton, Texas, 1961, adopted as a part of Parts II and III of Chapter 13 of the Code of Ordinances of the City of Denton, Texas, under the provisions of Ordinance No. 61-19, be, and the same ~s hereby amended as follows Ail of the hereinafter described property ~s hereby removed from the "D" - Dwelling D~strlct as shown on samd map, and all provls~ons of Parts II and III of Chapter 13 of the Code of Ordinances of the City of Denton, Texas, as provided by Ordinance No. 61-19, shall hereafter apply to sa~d property as "A-2" - Dwellzng District in the same mQnner as other property located ~n the "A-2" - Dwelling District, provided, however, that the owner shall dedmcate fmfteen (15) feet of th~s property ad3acent to I.O.O.F. Street as add~tzonal right-of-way for said street, and the set-back bu~ldzng line shall include this addltzonal flfteen (15) feet of right-of-way. St is understood, however, that thzs fifteen foot dedicated right-of-way may be ~ncluded in the off- street parkzng requirements relating to said property, and may be used for access purposes. The valldzty of thzs entzre ordinance depends and zs based on the valzdity of thzs set-back provision, said provision being a reasonable exercise of the police powers of the City of Denton, Texas Ail that certain property situated in the City of Denton, Texas, known as City Lots 1, 2, 2 1, 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 3, 4, 4.1, 5, and 6 of City Block 334, this property ia located on the North side of Eagle Drzve, on the W~at aide of I.O.O.F. Street and East of Bernard Street, its northern boundary line bezng approx- imately 50 feet North of the north side of Maple Street. SECTION II. The City Council of the City of Denton, Texas, hereby finds that such change and condition is in accordance with a compre- hensive plan for the purpose of promoting the general welfare of the Clty of Denton, and with reasonable consideration among other things, for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of buildings and encouragalng the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens. SECTION III. That this ordinance shall be in full force and effect immediately after 1ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council.
