SIDING'A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE
DATE
~HE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I.
IThat the Code of Ordinances of the City of Denton, Texas,
is h~rebv amended by substmtutlng new Article 13 02 mn Chapter
Thirteen-of samd Code of Ordmnanees, and by addmng subsectmons
(f), (g), (h) and (iD to Article 13 03 in Chapter Thirteen of
said Code of Ordinances, which shall hereafter read as follows
ARTICL~ 13 02 - Deflnltlon,~
(a) Subdivision
The term "subdivision" as used in Part I of this
Chapter shall mean the d~v~slon of any tract or
parcel of land into two or more parts for the pur-
pose, immediate or future, of sale or building
development Th~s term shall not include d~vlslon
or development for agricultural purposes but shall
include resubdlv~slon and ~ndustr~al development
(b) Resubdlvlsl,on
The term "resubdlvlslon" as used in Part I~of this
Chapter shall mean the dav~s~on of an ex~stlng sub-
division, together with any change of lot s~ze there~n,
or the relocation of any street l~nes or lot lines
(c) Lot Lines
The term "lot lines" as used an this Chapter shall
mean the pmoperty lines of any given tract or parcel
of land which circumscribe the area davaded by any
plat of record in the Plat Records of Denton County,
Texas, or in absence of such plat, the lot lines
shall mean those property lanes c~rcumscrablng the
lots independently ~solated on the official City of
Denton Plat on file in ~e office of the Tax Assessor
-Collector
(d) Person
The term "person" as used in th~s Chapter shall mean
any ~nd~vldual, association, fxrm or corporation
%RTICLE 13 03 - Subdivision and Plattlnq Requirements for
Buildlnq Purposes
(f) No building shall be constructed on or across existing
lot lines
(g) Lot Lines shall be changed only by resubdlvldlng or
replattlng in the manner provided by Part I of this
Chapter
!h) When a tract or parcel of land is resubdlvlded or
replatted, any and all additional rights-of-way and
easements which are required will be dedicated by the
person resubdlvidlng or replattlng the land, the same
as if the tract or parcel were being originally
subdivided
(1) Multiple dwelling, business and industrial property,
including all uses permitted under the "HI", "LI",
"B", "LB", "LR", "A-2" and "A-i" Districts provisions
of the Zoning Ordinance of the City of Denton, when
developed, shall be platted showing the building set-
back lines, from each street and abutting property,
and all utility, street, alley and access easements
and rights-of-way, and this plat will be filed of
record, upon approval by the Planning and Zoning
Co~lsslon, the same as subdivision plats Building
permits will only be issued for those areas shown on
this plat of record as proposed building areas within
the set-back lines
SECTIO~ I,I.
That all ordinances or parts of ordinances in force when
the provisions of this ordinance become effective which are
inconsistent or in conflict with the terms or provisions con-
rained in this ordinance are hereby repealed to the extent of
any such conflict
SECTION III.
That if any section, subsection, paragraph, sentence, clause,
phrase or word in this ordinance, or application thereof to any
person or circumstances is held invalid by any court of competent
]urlsldlctlon, such holding shall not affect the validity of the
remalhlng portions of this ordinance, and the City Council 9f the
City of Denton, Texas, hereby declares iL would have enacted
such Iremalnlng portions despite any such invalidity
SECTION IV
,That this ordinance shall become effective fourteen (14)
days Ifrom the date of its passage, and the City Secretary is
hereByl directed to cause the caption of this ordinance to be
published twice in the Denton Record Chronicle within ten (10)
daysiof the date of its passage
