1965-026 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
cITY OF DENTON, TE)~S, PROVIDING REQUIREMENTS FOR THE
INSTALLATION OF STREET LIGHTS, PROVIDING FOR pAYMENT
OF SAME BY THE CITY, SPECIFYING CERTAIN EXCEPTIONS
THERETO, REQUIRING PARTICIPATION FOR USE OF METAL POLES
OR UNDERGROUND INSTALLATIONS, REPEALING CONFLICTING
ORDINANCES, PROVIDING A SAVINGS CLAUSE, AND DECLARING
AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I.
That the Code of ordinances of the City of Denton. Texas.
is hereby amended by addlng new Article 17 111 to chapterC/~)
i ~v6~FFw~~f said Code of Ordlnances which shall hereafter read
as follows
ARTICLE 17 111 - STREET LIGHTING SERVICES
(a) Street Llghtlng - Conventlonal Overhead Installation
on Standard Wooden Pole Structure
Wherever practlcable and an keeping with the accepted
practlces of required ~llum~natlon standards the C~ty
of Denton shall ~nstall street l~ghtlng ~n all sub-
d~v~s~ons at no cost to the Developer or the Property
Owner, where poles are ex~stlng and/or planned to be
installed for d~str~but~on purposes The C~ty of ~
Denton shall determlne the location of all l~ghtlng
and the Developer or the Property Owner shall provide
the necessary easements for construction and main-
tenance of ~nstalled equipment
Where poles are not existing or planned to be installed
for d~strlbution purposes such street l~ghtlng shall
net be ~nstalled until the Developer or the Property
Owner shall have pald to the Department of public
Utll~t~es the sum of Sixty Five Dollars ($65 00) for
each lnstalled street l~ght
(b) Street L~ght~ng - Underground Installation on Metal
Street Lighting Standards
WhereVer practicable and ~n keeplng w~th the accepted
pract~es of required lllumlnatlon standards the C~ty
of Denton shall ~nstall or cause to be ~nstalled
street llghtlng ~n all subdlvls~ons, but such street
l~ght~ng on metal poles and underground installations
shall not be ~nstalled until the Developer or the
Property Owner shall have pa~d to the Department of
Public Utllltles the sum of One Hundred Dollars ($100 00)
for each installed street l~ght The requlred number,
location and mater~al types shall be determined by the
C~ty of Denton In the event that a higher level of
illumination ~s required (~ for ~ntersect~ons, high
density traffic or pedestrian areas, etc ) the City of
Denton will bear the additional cost ~ncurred ~n the
required larger fixture and ballast over and above
the prescribed standard 250 watt mercury vapor resi-
dential lighting fixture, and the Developer or Prop-
erty Owner shall provide the necessary easements for
construction and maintenance of installed equipment
SECTION II
That all ordinances or parts of ordinances in force when the
provisions of this ordinance become effective which are inconsis-
tent or in conflict with the terms or proviSiOnS contained in thzs
ordinance are hereby repealed to the extent of any such conflict
SECTION III.
That if any section, subsection,paragraph, sentence, clause,
phrase or word in this ordinance, or application thereof to any
person or circumstances is held invalid by any court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of this ordinance, and the City Council of the
City of Denton, Texas, hereby declares it would have enacted such
remaining portions despite any such invalidity
SECTION IV
That th~s ordinance shall become effective fourteen (14) days
from the date of its passage, and the City Secretary is hereby
dzrected to cause the caption of this ordinance to be published
twzce ~n the Denton Record Chronicle within ten (10) days of the
date of its passage
