1965-027 MAP OF THE cITY OF AN ORDIMANCE AMENDING THE ZONING ADOPTED AS A PART OF ~ENTON, TEX~S, 1961, AS SAME WAS PARTS II AND III OF CpI%PTER 13 OF THE CODE OF ORDIN- NCES OF THE CITY OF DENTON, TEX~S, BY oRDINANCE NO ~1-19, AND AS SAID MAP APPLIES TO CITY LOTS 10/178 J AND 12/178 J, AS SHOWN ON THE OFFICIAL CITY MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING CERTAIN PROVISIONS AND RESTRICTIONS, AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY oRDAINS That the Zoning Map of the City of Denton, Texas, 1961, adopted as a part of Parts II and III of Chapter 13 of the Code' of ordinance of th~ Ci~ ~ Denton, Texas, under the proVis~ons of ordnance ~o o~-~ be, and the same is hereby amended as follOW~ Ail of the hg~lnafter described property is hereby removed fro~'t~e "R'- Dwelling District as shown on said map, and all provisions of Parts II and III of chapter 13 Of the Code of Ordinances of the City of Denton, Texa~ as provided by Ordinance No 61-19, shall hereafter apply to said property as "LB" - Local Business District in the same manner as other property located in the "LB" - Local Business District, provided, however, and this ordinance is conditioned upon provisions that, all structures~located on sa~d property shall be set back a minimum of fifty (50) feet from Highway Loop 288 right-of-way, except that this flfty-foo~ (50') area may be used for off-street parking, driveways, canopies, and pump ~slands, but that no canopy or pump island shall be located within twenty-five (25) feet of the right-of-Way of Loop 288 The validity of this entire ordinance depends and is based upon the validity of this set-back provision, said provision being a reasonable exercise of the police powers of the City of Denton, Texas Ail that certain property sltuated ~n the C~ty of Denton, Texas, known as City Lots 10/178 J and 12/178 J being located 200 feet south of H~ghway 24 East and adDaeent to Loop 288 SECTION II. That the C1ty Council of the C1ty of Denton, Texas, hereby f~nds that such change and condition ~s 1n accordance with a com- prehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, And w~th reasonable cons~deratlon, among other th~ngs, for the character of the d~str~ct and for ~ts pe- culiar su~tablllty or particular uses, and w~th a v~ew to con- serving the value of buildings, protecting human llves, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and ~ts clt~zens SECTION III That this ordinance shall be ~n full force and effect lmmed~ately after ~ts passage and approval, the required publlc hearings having heretofore been bald by the Plannzng and Zoning Co~Ss~on and the C~ty Council ~~~_ PASSED and APPROVED this ~day of ,A D 1965 Warren Wh~tson, Jr , Mayor C~ty of Denton, Texas C~ty of Denton, Texas APPROVED AS TO LEGAL FORM j~' ~ Barton, Czty Attorney ty of Denton, Texas
