2007-240ORDINANCE NO.OJDD /' O AN ORDINANCE PROVIDING FOR THE SALE OF REAL PROPERTY LOCATED AT 816 ALLEN STREET AS A PART OF THE CITY'S INFILL NEW CONSTRUCTION PROGRAM FOR AFFORDABLE HOUSING FOR SALE TO LOW-MODERATE INCOME BUYERS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton in the Action Plan for Housing and Community Development, approved implementation and funding for an Infill New Housing Construction Program (the "Program") for the benefit of low to moderate-income households; and WHEREAS, the Program which was approved for implementation by City Council, specified the acquisition of vacant properties for the purpose of new affordable housing construction; and WHEREAS, the subject property is commonly known as 816 Allen Street which is more particularly described as a parcel of land described as Lot 3, Block 7, Alex Robertson Addition, City of Denton, Denton County, Texas and further described in document number 2006-98024 in the deed records of Denton County, Texas (the "Property") WHEREAS, the City has previously acquired the Property for the purpose of infill housing development for low and moderate-income buyers; and WHEREAS, the Sale of the Property to low or moderate-income buyers is exempt from the requirements of Chapter 272 of the Local Government Code (the Code) pursuant to Section 272.001(g) of the Code, which authorizes sales for less than fair market value for low to moderate-income housing; and WHEREAS, the City Council finds that the sale of the Property to a low or moderate- income buyer under the Program is a valid public purpose and is in the public interest; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The Property is hereby incorporated into the Program under which the City of Denton may acquire, improve and convey real property that is appropriate for new construction to promote conservation of Denton neighborhoods and provide affordable housing to low ormoderate-income buyers. SECTION 3. The City Manager, or his designee, is hereby authorized to convey the property to a qualified low or moderate-income household on such terms and conditions and for such consideration as is required and authorized by the Program, without further City Council action.
