2007-067 S:\Our Documcnts\Ordinances\07\CA06-0008 Draft Ordinance 3.20,07.DOC ORDINANCE NO. 2007-/)/; 7 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN AMENDMENT TO THE LAND USE PLAN OF THE LAND ELEMENT OF THE DENTON PLAN FOR THE CITY OF DENTON, TEXAS, THE AREA FOR AMENDMENT ENCOMPASSING A 152.9- ACRE TRACT OF LAND, GENERALLY LOCATED ON THE EAST SIDE OF IH-35, NORTH OF WEST UNIVERSITY DRIVE / U.S. 380 AND WEST OF BONNIE BRAE STREET, AND MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN EXHIBIT "A", ATTACHED HERETO, AND DEPICTED ON EXHIBIT "B", ATTACHED HERETO, AND LEGALLY DESCRIBED AS A TRACT OF LAND SITUATED IN THE FRANCIS BASTON SURVEY, ABSTRACT NO. 43, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. (CA06-0008) WHEREAS, pursuant to Denton Development Code S35.3.3.C.l.c, the City Manager has recommended an amendment to the Land Use Plan of the land element ofthe Denton Plan for 152.9 acres of land from "Existing Land Use", "Neighborhood Centers" and "Community Mixed Use Centers" land use designations to "Regional Mixed Use Centers" and "Neighborhood Centers" land use designations, as requested by Allegiance Development; and and WHEREAS, on December 7, 1999, the City of Denton adopted the Denton Plan, 1999-2020; WHEREAS, on March 14, 2007, the Planning and Zoning Commission recommended approval of the Land Use Plan Amendment; and WHEREAS, the City Council finds that the Land Use Plan Amendment is in the best interests ofthe health, safety and general welfare of the citizens of the City of Denton, Texas; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference, and the City Council hereby finds that all legal criteria for approval have been satisfied, including those set forth in S35.3.3B of the Denton Development Code. SECTION 2. The Land Use Plan is hereby amended for 152.9 acres ofland, depicted on the map attached hereto and incorporated herein by reference as Exhibit "B", and more particularly described in the legal description attached hereto and incorporated herein by reference as Exhibit "A" (the "Property"). SECTION 3. The City's official land use map is amended to show the change in the land use designation. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable.
