AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A
COMPREHENSNE PLAN AMENDMENT-FROM NEIGHBORHOOD CENTERS LAND USE
TO A REGIONAL MIXED USE CENTERS LAND USE, ENCOMPASSING APPROXIMATELY
7.5972 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF CRAWFORD ROAD
AND INTERSTATE 35 WEST INTERSECTION, DESCRIBED AS A TRACT OF LAND
SITUATED IN THE ELIZANO PIZANO SURVEY, ABSTACT NO. 994, CITY OF DENTON,
DENTON COUNTY, TEXAS; SAID TRACT BEING ALL OF THAT CERTAIN TRACT OF
LAND DESCRIBED IN SPECIAL WARRANTY DEED WITH VENDOR'S L[EN TO I-35 AND
CRAWFORD ROAD PARTNERS, LTD,. RECORDED IN VOLUME 4163, PAGE 268 OF THE
DEED RECORDS OF DENTON COUNTY, TEXAS; AND PROVIDING FOR SEVERABILITY
AND AN EFFECTNE DATE. (CA07-0002)
WHEREAS, The City Manager has initiated and recommended approval of a Comprehensive
Plan Amendment from a "Neighborhood Centers" future land use designation to a "Regional Mixed
Use Centers" future land use designation, as requested by Quorum Equities Group, LLC.
WHEREAS, on April 11, 2007, the Planning and Zoning Commission recommended
approval of the requested plan change; and
WHEREAS, the City Council finds that the change meets the procedural requirements and
approval criteria set forth in §35.3.3 of the Denton Development Code, taking into consideration the
factors listed therein; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference as true.
SECTION 2. The future land use category definition is hereby changed from a
Neighborhood Centers to a Regional Mixed Use Centers classification designation for 7.5972 acres
of land located at the northeast corner of Crawford Road and I-35 W intersection.
SECTION 3. The Denton Plan is hereby amended to show the change in land designation.
SECTION 4. 1f any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall become effective immediately upon its passage and
approval.
