2007-109ORDINANCE NO. 2OD ~- /D AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN AMENDMENT TO THE FUTURE LAND USE PLAN OF THE LAND ELEMENT OF THE DENTON PLAN FOR THE CITY OF DENTON, TEXAS, THE AREA FOR AMENDMENT ENCOMPASSING A 256.91-ACRE TRACT OF LAND GENERALLY LOCATED ON THE EAST SIDE OF IH-35, SOUTH OF WEST UNIVERSITY DRIVE / U.S. 380 AND WEST OF BONNIE BRAE STREET, AND MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN EXHIBIT "A", AND DEPICTED ON EXHIBIT "B", BOTH OF WHICH ARE ATTACHED HERETO AND INCORPORATED BY REFERENCE HEREIN; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. (CA06-0008) WHEREAS, on December 7, 1999, the City of Denton adopted the Denton Plan, 1999-2020; and WHEREAS, pursuant to the procedures set forth in §35.3.3.C.l.c ofthe Denton Development Code, the City Manager recommended and initiated an amendment to the Denton Plan, as requested by Allegiance Development, from the Land Use Plan of the land element of the Denton Plan for 256.91 acres of land, to redesignate this azea from a "Neighborhood Centers" land use designation to the "Regional Mixed Use Centers" and "Neighborhood Centers" land use designations; and WHEREAS, on May 9, 2007, the Planning and Zoning Commission recommended approval of the requested Land Use Plan Amendment; and WHEREAS, the City Council finds [hat the approval criteria set forth at §35.3.3.B of the Denton Development Code have been satisfied, specifically including the factors set forth at §35.3.3.B.3 of the Denton Development Code, that .all notice, procedural and substantive requirements of State law (including, but not limited to Chapters 211 and 213 of the Texas Local Government Code), the Denton Plan, and the Denton Development Code have been satisfied, and that the proposed Land Use Plan Amendment is in the best interests ofthe health, safety and general welfaze of the citizens of the City of Denton, Texas; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Land Use Plan is hereby amended for 256.91 acres of land legally described and depicted in Exhibits A and B, attached hereto and incorporated herein by reference (the "Property"), to redesignate the future land use classifications for said Property from the "Neighborhood Centers" future land use designation to the "Regional Mixed Use Centers" and "Neighborhood Centers" future land use designations, as illustrated in Exhibit B. Notwithstanding the above-referenced real property description, the property being reclassified includes all property to the centerline of all adjacent street rights-of-way." SECTION 2. The City's official land use map is amended to show the change in the future land use designation. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance aze severable. SECTION 4. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
