2005-226S:\Our Documents)Ordinances\05UuvenileCaseManagerFund.doe ORDINANCE NO. 2005 - 2 z AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE CREATION OF A JUVENILE CASE MANAGER FUND PURSUANT TO ARTICLE 102.0174 OF THE CODE OF CRIMINAL PROCEDURE; PROVIDING FOR A REPEALER; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article 102.0174 of the Texas Code of Criminal Procedure, as amended, provides for the creation of a juvenile case manager fund by the governing body of a municipality; and WHEREAS, Article 102.0174 of the Texas Code of Criminal Procedure, as amended allows for the collection of a juvenile case manager fee not to exceed $5.00 as a cost of court from defendants convicted of fine-only misdemeanor offenses in a municipal court; and WHEREAS, that the Denton City Council finds that it is in the interest of the citizens of Denton to establish a juvenile case manager fund; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council hereby establishes the juvenile case manager fund pursuant to Article 102.0174 of the Texas Code of Criminal Procedure, as amended. SECTION 2. The City Council hereby established juvenile case manager fee shall be collected from all defendants convicted of fine-only misdemeanor offenses in Denton Municipal Court. The fee shall be in the amount of Five Dollars ($5.00) per fine-only misdemeanor offense. For purposes of this ordinance, a conviction shall include cases disposed of by judgment, deferred adjudication or cases dismissed by the completion of a driver's safety course. SECTION 3. That a copy of this schedule of the fee shall be maintained on file in the office of the City Secretary. SECTION 4. All ordinances or parts of ordinances in force when the provisions of this ordinance became effective which are inconsistent, or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict. SECTION 5. If any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity.
