2004-105O INANCE NO. AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING CHAPTER 21, ARTICLE I OF THE CODE OF ORDINANCES OF THE CITY OF DENTON BY ADDING A SECTION PROHIBITING SOLICITING NEAR AUTOMATED TELLER MACHINES WHICH ARE LOCATED IN PUBLIC PLACES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED FiVE HUNDRED DOLLARS; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Chapter 21 "Offenses" of the Code of Ordinances of Denton, Texas is hereby amended by adding Section 21-6 prohibiting near ATM's located in public places which shall read as follows: Sec. 21-6. Prohibited acts. It shall be unlawful for any person to solicit another in a public place at the times, locations and in the manner specified below: I. Within 50 feet of any automated teller machine not enclosed within a building. SECTION 2. That all provisions of the ordinances of the City of Denton in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Denton, not in conflict with the provisions of this ordinance, shall remain in full force and effect. SECTION 3. That if any provision of this ordinance or application thereof to any person or circumstance is held invalid, such invalidity shall not affect the other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 4. Any person adjudged guilty of violating this ordinance shall be guilty of a misdemeanor and punished by a fine not to exceed Five Hundred Dollars ($500.00). SECTION 5. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage.
