AN ORDNANCE OF THE CITY OF DENTON, TEXAS, CREATUqG AN OVERLAY DISTRICTAND APPROvnJG A SPECIAL SIGN DISTRICT PLAN ON AN APPROXMATE 133.5 ACRESOF LAND LOCATED AT THE NORTHWEST AND SOUTHWEST CORNERS OFINTERSTATE 35 EAST FRONTAGE ROAD AND WIND RIVER LANE LEGALLYDESCRIBED AS TRACT 15 OF THE M.E.P. & P.R.R. SURVEY ABSTRACT NUMBER 950 DqTHE CITY OF DENTON, TEXAS; PROVDHqG FOR A PENALTY nq THE MAXIWUM
AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVDn{G FOR AN EFFECTIVE

WHEREAS, Shelton Development, has applied for adoption of a Special Sign District on real
property containing approximately 133.5 acres of land in Regional Center Commercial Downtown(RCC-D) zoning district, such real property and legally described as Tract 15 of the M.E.P. &P.R.R
Survey (hereinafter defined as the “Property“); and
WHEREAS, on March 24, 2004, the Planning and Zoning Commission, after a public
hearing, recommended approval with conditions of the Special Sign District; and
WHEREAS, the City Council finds that the Special Sign District is in compliance with the
Subchapter 15 of the Development Code of the Code of Ordinances of the City of Denton, and isconsistent with the Denton Plan; NOW THEREFORE
THE COUNCE OF THE CITY OF DENTON HEREBY ORDArNS :
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The Special Sign District is hereby approved on the Property subject to the
following conditions:
a.Four (4) ground signs are permitted along the Interstate 35 East Frontage Road in the
locations shown on Exhibit A, attached hereto and made a part hereofby reference, and must
be constructed as shown on Exhibits B & C, attached hereto and made a part hereof by
reference
b.A total of fourteen (14) monuments signs are permitted in this Special Sign District. Such
signs are subject to the conditions set forth in Exhibit B, attached hereto and made a part
hereof by reference, regarding maximum number of monument signs per street, maximum
height, and maximum size. All monument signs shall be spaced a minimum of 100 feet from
all other monument signs in this Special Sign District. All monument signs shall be similar
in construction materials and architectural design to the sign depicted in Exhibit D, attached
hereto and made a part hereof by reference.
C.In addition to all other wall signs permitted by Subchapter 15 of the Development Code, one
(1) theater wall sign projecting 15 feet above the roofline is permitted as depicted in Exhibit
E, attached hereto and made a part hereof by reference. This projecting sign may be
illuminated, provided that the illuminated elements of the sign are directed toward the on-site

parking lot such that the sign does not directly shine on surrounding residential property.
Such additional wall signs shall comply with the regulations set forth in Subchapter 15 ofthe
Development Code.
All other signs of a type not expressly provided for in this Special Sign District are permitted9
provided that such signs comply with all of the applicable regulations set forth in Subchapter
15 of the Development Code. Notwithstanding anything herein to the contrary, the only
permanent ground signs permitted in this Special Sign District, with the exception of
directional signs and menu boards, are those provided for in Sections 2(a) and (b) of thisordinance.

e. The boundaries of this Special Sign District are depicted on Exhibit F, attached hereto and
made a part hereof by reference (the “Property“).
SECTION 3. This ordinance shall supercede all requirements of the Sign Ordinance
affecting the Property that are in conflict with or addressed by the Special Sign District Plan and the
Special Sign District Regulations established by this ordinance. All other provisions of the Sign
Ordinance shall remain in full force and effect against the Property.
SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense.
SECTION 5. This ordinance shall become effective fourteen (14) days from the date of itspassage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record Chronicle, the official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage.
