2004-221ORDINANCE NO. ~04-~2 / AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROHIBITING PARKING DURING CERTAIN HOURS ON THE EAST SIDE OF NEWTON STREET BEGINNING 461 FEET NORTH OF ITS INTERSECTION WITH MORSE STREET AND CONTINUING NORTH TO A POINT APPROXIMATELY 856 FEET NORTH OF THE INTERSECTION; PROVDING A SAVINGS CLAUSE; PROVDING A SEVERABILITY CLAUSE; PROVDING A PENALTY NOT TO EXCEED TWO HLrNDRED DOLLARS; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. When signs or markings are in place giving notice thereof, no person shall park a vehicle on school days from 7:00 a.m. to 4:00 p.m. upon the following street in the City of Denton: The east side of Newton Street Drive beginning 461 feet north of its intersection with Morse Street and continuing north to a point 856 feet north of the intersection. SECTION 2. The provisions of Section I prohibiting the parking of vehicles shall apply during the specified times on the designated portion of the above named street or streets except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control device. SECTION 3. That all provisions of the ordinances of the City of Denton in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Denton, not in conflict with the provisions of this ordinance, shall remain in full force and effect. SECTION 4. That if any provision of this ordinance or application thereof to any person or circumstance is held invalid, such invalidity shall not affect the other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person adjudged guilty of parking a vehicle in violation of this ordinance shall be guilty of a misdemeanor and punished by a fine not to exceed Two Hundred Dollars ($200.00). SECTION 6. This Ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this Ordinance to be published twice hi the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage.
