AN ORDINANCE AMENDING, REPEALING AND REPLACING ORDINANCE NO. 91-039
OF THE CITY OF DENTON, TEXAS, ESTABLISHING FEES TO BE CHARGED FOR
OVERDUE BOOKS AND MATERIALS FOR THE LIBRARIES OF THE CITY OF
DENTON, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING A SEVERABILPI'Y CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Denton provided in Ordinance 91-039 for the fees to be chazged
for overdue books and materials for the libraries operated by the City of Denton, Texas; and
WHEREAS, the City of Denton should operate a cost-effective and efficient library
system; and
WHEREAS, the City of Denton desires to revise and update fees to be chazged for
overdue books and materials to reflect current costs: and
WHEREAS, the City of Denton finds that it is in the public interest to change the fees for
the librazy system; NOW, THEREFORE,
THE COUNCIL OF THE CTfY OF DENTON HEREBY ORDAINS:
SECTION 1. That Ordinance No. 91-039 enacted by the City Council on Mazch 5, 1991,
is hereby amended, repealed and replaced by hereby approving and establishing the following
fees for library services as follows:
1. For Extended Use:
a. A customer may borrow books, music CDs and audio books, for a three-week
period. After that time the customer shall pay an extended use fee of twenty-five
cents ($0.25) a day per item;
b. A customer may borrow videocassettes and CD-ROMs for a three-week period.
After that time, the customer shall pay an extended use fee of one dollaz ($1.00)
per day, per item;
c. A customer may bonow DVDs for a two-week period. After that time, the
customer sha11 pay an extended use fee of one dollar ($1.00) per day per item.
2. For replacement of Lost Cazds:
The fee for replacement of cards is two dollars ($2.00) per cazd.
SECTION 2. That a copy of this schedule of fees and charges shall be maintained on file
in the office of the City Secretary.

SECTION 3. That all ordinance or parts of ordinance in force when the provisions of this
ordinance become effective which are inconsistent or in conflict with the terms or provisions
contained in this ordinance are hereby repealed to the extent of any such conflict.
SECTION 4. That if any section, subsection, paragraph, sentence, clause, phrase, or
word in this ordinance, or application thereof to any person or circumstance is held invalid by
any court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this ordinance, the City Council of the City of Denton, Texas, hereby declares that
they would have enacted such remaining portions despite any such invalidity.
SECTION 5. That the Ordinance and Fees herein adopted shall be effective and applied on
or after October 1, 2004, and a copy of said fees, and charges shall be maintained on file in the
Office of the City Secretary.
