AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR, AUTHORIZING, AND APPROVING THE EXPENDITURE OF FUNDS FOR THE PURCHASE OF PROMOTIONAL COMMERCIALS FROM COMCAST ADVERTISING, DENTON, TEXAS, PERTAINING TO DENTON MUNICIPAL ELECTRIC, WHICH ARE AVAILABLE FROM ONLY ONE SOURCE IN ACCORDANCE WITH THE PERTINENT PROVISIONS OF CHAPTER 252 OF THE TEXAS LOCAL GOVERNMENT CODE EXEMPTING SUCH PURCHASES FROM THE REQUIREMENTS OF COMPETITIVE BIDDING; AND PROVIDING AN EFFECTIVE DATE (FILE 3085-COMCAST ADVERTISING IN THE AMOUNT OF $41,028). WHEREAS, §252.022(a)(7) of the Texas Local Government Code provides that procurements of certain items or services that are only available fi:om one source, as described therein, need not be submitted to the competitive bid process; and WHEREAS, the City Council wishes to purchase promotional commercial spots pertaining to Denton Municipal Electric ("DME") from the City's sole local cable provider, Charter Media of Denton, which services are presently available fi:om only one source, and are permitted in accordance with §252.022 of the Texas Local Government Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. That the following purchase of services, as described in the "File Number" listed below, and on file in the office of the City's Purchasing Agent, is hereby authorized and approved: FILE NUMBER VENDOR AMOUNT 3085 Comcast Advertising $41,028 SECTION 2. That the acceptance and approval of the above item shall not constitute a contract between the City and Charter Media of Denton submitting the price quotation for such commercials until Charter Media of Denton shall comply with all requirements specified by the City's Purchasing Department. SECTION 3. That the City Manager is hereby authorized to execute any contracts or other related documents relating to the item specified in Section 1. hereof, and the expenditure of funds pursuant to said contract or written order, is hereby authorized.
