AN ORDINANCE APPROVING A CHANGE ORDER TO THAT CERTAIN
PROFESSIONAL SERVICES CONTRACT BETWEEN THE CITY OF DENTON AND
STEVEN J. KUNKEL & ASSOCIATES, INC. DATED MARCH 13, 2003 TO PROVIDE
REAL PROPERTY APPRAISAL SERVICES FOR ACQUISITIONS FOR THE CLEAR
CREEK INTERCEPTOR SEWER LINE PROJECT; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Denton and Steven J. Kunkel & Associates, Inc. entered into
that certain professional services agreement dated March 13, 2003 in the amount of $22,500.00
for real property appraisal services for the Clear Creek Interceptor Sewer Line Project (the
"Project"); and
WHEREAS, changes in the Project have necessitated the need for additional appraisal
services requiring a change order in the amount of $15,000.00 as more particularly described in
the Addendum 1 attached hereto and made a part hereof by reference (the "Change Order"); and
WHEREAS, the original contract amount together with the Change Order amount
exceeds $25,000.00, thereby requiring City Council approval; and
WHEREAS, the City Council finds that the Change Order is in the public interest; NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of the ordinance
are incorporated herein by reference.
SECTION 2. The Change Order is hereby approved and the City Manager, or his
designee, is hereby authorized to execute the Change Order on behalf of the City.
SECTION 3. The City Manager or his designee is hereby authorized to make the
expenditures set forth in the Change Order.
SECTION 4. This ordinance shall become effective immediately upon its passage and
approval.

I appreciate the opportunity' to submit this proposal to provide additional valuation services in
connection with tho above-captioned project, It is my understanding that the City of Denton. is
the client in this assigamem and tho intended user of the 'appraisal. It is also my understanding
that the intended Use of the appraisal is to thnction as an aid in negotiating the purchase of the
de. fined interests in the above-referenced real propea-ty, and that the appraisal may be utilized for
con~emnntion l~u'pos~,
Ii is my understanding that the PUrpoSe of the appraisal is to develop a current opinion of the total
compensation for thc purchase of the defined interest in the abo~r~erenced property.. The value
premise will,he that· of the property's "as is" condition as of the effective date valuation. Our
opinion of the total compensation will reflect tho "mnrket value" Of the defined property interests
in the above-referenced real property, as .well as all "compensable" damages to the remainder
property. .
The scope of the appraisal assi8nment will include a complete identification'and analysis of the whole
property. If the ab6ve-capfioned property is part of an economic unit that differs i~om the whole site,
we will develop an opinion of the total compensation atm'buted to each of the different economic units,
but will not develop an opin/on of the value 0fthe whole s/to. The scope of the assignment will also
include a complete analysis of the effect of the proposed Use Of the aheve~referenced property on the
remainder property. The scope of th~ s~4~.i,mi will also include a limited inspection and anallais of
the whole propen'y improvemeuts; but will not include a valuation 0fthe whole pmpen'y as presently
improved.

The scope of the condemnation support assignment will include review of previously prepared
appraisals, ~esenrcl~ and analysis of market transacfons, and inspection, research and analysis of
subject parcels.. The scope.of service also includes expert, witnass .testimony, including
depositions, hearings, interrogatories, 'meetings, and preparation time.
The appraisal aSSignment will include the development of'a "Complete Appraisal" and the data
and our total.compensation conclusion end anelyses will be presented in a "summry Report"
· utilizing a narrative. format.. This assignment will be completed 5in conformity with the Uniform
Standards of Professiomfl Appraisal Practice (USPAP) promulgated by the Appraisal FOUndation,
and the Code of.Professional Ethics of the Appraisal Institute.
My fee .is based on the amoUnt of time spent on the assignment, as well as the complexity of the
assignment. In this instance, my total fee will not ~xcA~d $15,000; which includes $3,500 for the
appraisal assignment and $11,:500 for the condemnation support assignment, with an hourly rate
of $150. The totai.fee includes .all. expenses incurred in the completion of this assignment.
However~ my fee is subject to change in the. event.that Unexpected ciro~m~mnces are encountered
during the ass;~o~ment that ~sults in significant additional time and/or expenses required in
complefin~ the assortment. HoweVer, your written approval is req 'un~l prior to commencement
of additional sel~ices and/or modification of the fee..
I anticipate completion of the a~8~u~ent'end delivery of two original coPi~ of the written report
within 30 days of your written acceptance of this Proposal. However, if relevant informaiiun
needed for the~ completiou of the assignment is .not received in a timely manner, the completion
date may be delayed.
