2003-350S:\Our Doeuments\Ordinances~03~S olid Waste Rate Repeal Onl-2.doc NO. 2g ,q-JO- AN ORDINANCE REPEALING ORDINANCE NO. 2003-265 (THE "SOLD WASTE RATE ORDINANCE"); REINSTATING THE SOLD WASTE RATE ORDINANCES THAT WERE IN EFFECT IMMEDIATELY BEFORE THE PASSAGE OF THE "SOLID WASTE RATE ORDINANCE"; PROVIDING A SAVINGS CLAUSE; AND PROVDING AN EFFECTIVE DATE. WHEREAS, on or about September 23, 2003 the City Secretary received a Referendum Petition seeking to repeal Ordinance No. 2003-265 (the Solid Waste Rate Ordinance) which was passed by the City Council on September 2, 2003; and WHEREAS, the City Secretary has presented the Referendum Petition to the City Council and certified the Petition as sufficient in accordance with the City Charter; and WHEREAS, the City Council, at its regularly scheduled meeting of October 21, 2003, affirmatively answered the question required by the Charter "Shall the ordinance specified in the Referendum Petition be repealed"; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. Ordinance No. 2003-265 (the Solid Waste Rate Ordinance) passed by the City Council on September 2, 2003 is hereby repealed. SECTION 3. The previous solid waste rate ordinances not mentioned herein, that were in effect immediately before the passage of the Solid Waste Rate Ordinance, including Ordinance No. 2002-270, passed on September 3, 2002, shall be reinstated and remain in full force and effect it being the intent of the City Council that until a new solid waste ram ordinance is enacted that Ordinance No. 2002-270 shall govern all rates for solid waste. SECTION 4. This ordinance shall become effective immediately upon its passage and approval.
