AN ORDINANCE OF THE CITY OF DENTON, TEXAS, REZON1NG APPROXIMATELY 22.55 ACRES OF LAND IN THE CITY OF DENTON FROM NEIGHBORHOOD RESIDENTIAL 3 (NR- 3) TO NEIGHBORHOOD RESIDENTIAL 4 (NR-4) ZONING DISTRICT; SAID REAL PROPERTY BEING GENERALLY LOCATED ALONG THE WEST OF BELLAIRE ON MCKINNEY AVENUE, EAST OF MACK, WEST OF JOSHUA DRIVE; PROVIDING A PENALTY CLAUSE WITH A MAXIMUM FINE OF $2000.00 PER DAY FOR A VIOLATION OF THIS ORDINANCE; A SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. (Z02-0035). WHEREAS, the owner has initiated a change in zoning for approximately 22.55 acres of land as more particularly described in Exhibit "A" attached hereto and made a part hereof by reference (the "Property") from a Neighborhood Residential 3 (NR-3) to Neighborhood Residential 4 (NR-4) zoning district classification and use designation; and WHEREAS, on September 25, 2002, the Planning and Zoning Commission recommended approval of the requested zoning; and WHEREAS, the City Council finds that the zoning is consistent with the Comprehensive Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Property is hereby changed from Neighborhood Residential 3 (NR-3) zoning district classification and use designation to Neighborhood Residential 4 0XlR-4) zoning district under the comprehensive zoning ordinance of the City of Denton, Texas. SECTION 2. The City's official zoning map is amended to show the change in zoning district classifications. SECTION 3. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 4. If any section, subsection, paragraph, sentence, phrase or word in this ordinance, or application there of to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION 5. This ordinance shall become effective fourteen (14) days fi'om the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
