2002-335ORDINANCE NO. OD - AN ORDINANCE BY THE CITY OF DENTON ABANDONING AND VACATING ITS GAS AND UTILITY EASEMENT RECORDED IN VOLUME 569, PAGE 681, DEED RECORDS OF DENTON COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Hunt Properties, Inc., has made a request to the City Council of the City of Denton, Texas to close and abandon a gas and utility easement containing approximately 0.06 acre of land recorded in Volume 569, Page 681, Deed Records of Denton County, Texas (the "Property"); and WHEREAS, the City of Denton Engineering Department has reviewed the Property and determined that it is excess easement and is not needed for future utility purposes; and WHEREAS, the City Council hereby finds and determines that the Property is not needed for gas and utility easement purposes and it is in the public interest to abandon the Property and the City's interests therein to the landowner, Hunt Properties, Inc. ("Current Owner"); NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION L The Property recorded in Volume 569, Page 681 of the Deed Records of Denton County, Texas is vacated and permanently abandoned as a public easement. SECTION 2. The interests of the City of Denton in the Property is hereby released and will revert to the owners as provided by law. SECTION 3.
