AN ORDINANCE OF THE CITY OF DENTON, TEXAS, CREATING AN OVERLAY DISTRICT
(SD-I) AND APPROVING A SPECIAL SIGN DISTRICT PLAN ON AN APPROXIMATE 7.52
ACRES OF LAND LOCATED ALONG THE NORTH RIGHT-OF-WAY LINE OF 1-35
BETWEEN TEASLEY AND MEADOW IN THE CITY OF DENTON, TEXAS; PROVIDING
FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, 1-35 Denton Land Ltd., has applied for adoption of a Special Sign District on
real property containing approximately 7.52 acres of land in Downtown Commercial General (DC-
G) zoning district, such real property being more particularly described in Exhibit "A" attached
hereto and made a part hereof by reference (the "Property"); and
WHEREAS, on April 24, 2002, the Planning and Zoning Commission, atter a public heating,
recommended approval of the Special Sign District; and
WHEREAS, the City Council fmds that the Special Sign District is in compliance with the
City of Denton Sign Ord'mance, Chapter 33 of the Code of Ord'mances of the City of Denton, and is
consistent with the Denton Plan; NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Special Sign District is hereby approved on the Property subject to the
following conditions:
Signage on the Property shall be developed, constructed, used, and maintained in
accordance with and limited to the Special Sign District Plan attached hereto and
made a part hereof as Exhibit "B" and the Special Sign District Regulations attached
hereto and made a part hereof as Exhibit "C".
The Special Sign District Plan calls for signage associated with six lots. A final plat
of the Property has been approved which consolidates into one lot the most northerly
two lots, being lots 5 and 6 (the "Consolidated Lots"). Until such time as the
Consolidated Lots are re-platted into two lots, one of the Monument D signs will not
be authorized.
SECTION 2. This ordinance shall supercede all requirements of the Sign Ordinance
affecting the Property that are in conflict with or addressed by the Special Sign District Plan and the
Special Sign District Regulations established by this ordinance. All other provisions of the Sign
Ordinance shall remain in full rome and effect against the Property.
SECTION 3. Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense.
SECTION 4. This ordinance shall become effective fourteen (14) days from the date of its
passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record Chronicle, the official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage.

Article 1. IN GENERAL
Sec. 1.1 Purpose and intent.
(a)
The purpose and intent of the creation of this Special Sign District for Denton Park 35
Addition is to grant and regulate a signage plan that will allow properties within Denton Park
35 Addition to deviate fi.om the sign regulations of Chapter 33 of the Denton Code (the
"Denton Sign Ordinance") in compliance with an alternative comprehensive plan that is
standardized in design, and which is equal to or superior to what could be accomplished
under the standard regulations of the Denton Sign Ordinance.
It is the intent of the creation of this Special Sign District for Denton Park 35 Addition (the
"Special Sign District") that the Denton Park 35 Addition, and the six (6) lots to be
developed, platted and sold therein, shall be allowed to construct, erect and maintain signage
therein and thereon, jointly and on each of the individual lots, as defined herein, perpetually,
when in compliance with permitting procedures, permitting fees and renewals as required
and/or as defined by the Denton Sign Ordinance, as revised and amended from time to time.
(c) All signage defined herein may be deemed to be dual faced, except for signage mounted on
the facade of a building or fence.
Sec. 1.2 Types of Signs.
1.2.1 Sign.
A sign is an outdoor structure, sign, display, light device, figure, painting, drawing, message, plaque,
poster, billboard, or other thing that is designed, intended, or used to advertise or inform. "One sign" or
"a sign" means any number of signs located on or supported be a single or common supporting structure.
1.2.2 Attached Sign.
An attached sign is a sign, other than a wind device sign, attached to or supported by any part of a
building, inchiding but not limited to a wall, roof, window, canopy, awning, or marquee. Wall, roof, and
projecting signs shall be considered attached signs.

1.2.3 Flag.
A flag is a wind device sign. No permit shall be required to display one (1) U.S. or one (1) Texas flag,
or both, on any one (1) premise. If the exempted flags are displayed on flagpoles in the manner of a
ground sign, the number, height, size and spacing requirements applicable to ground signs shall not
apply, but the flags and poles shall maintain the required setbacks for ground signs.
In addition, on a premise, no permit shall be required to display one (1) flag that is displayed on a
flagpole in the manner of a ground sign, the number and spacing requirements applicable to ground
signs shall not apply, but the flag and poles shall maintain the required setbacks for ground signs; and
the exempted flag shall have a maximum effective area of fifty (50) square feet and a maximum height
of thirty (30) feet, unless it is flown on the same flagpole used to display a U.S. or Texas flag.
1.2.4 Ground Sign.
A ground sign is a sign, other that a wind device sign, whose principal support is provided by burying,
anchoring or otherwise connecting the sign, or supporting structure thereof, to the ground and which is
not a portable sign or attached sign.
1.2.5 Holiday Sign.
A holiday sign is a ground or attached sign containing only holiday messages and no commercial
advertising.
1.2.6 Monument Sign.
A monument sign is a ground sign, other than a wind device sign, whose framing is solid from the
ground up, and is made of stone, concrete, metal, wood planks or beams, brick or similar materials. Any
pole(s) or support of this sign shall be concealed.
1.2.7 Off-premises Sign.
An off-premises sign is a sign displaying advertising copy that pertains to a business, person,
organization, activity, event, place, service, or product not principally located or primarily manufactured
or sold on the premises on which the sign is located.
1.2.8 Private Traffic Control Sign.
A private traffic control sign is an on-premise ground sign which directs the movement of traffic on
private property or warns of obstacles, overhead clearances, or control parking, including, but not
limited to, entrance and exit signs. The sign must be less than ten (10) square feet in effective sign area,
less than six (6) feet in height, and be placed where they will not interfere with the safe movement of
vehicles or pedestrian. The sign may contain directional or waming language, including contact
telephone numbers, and may contain a company logo or symbol.
1.2.9 Projecting Sign.
A projecting sign is an attached sign, other than a wind device sign, which is wholly erected on, affixed
to, or supported by any building wall and which extends beyond the building wall by more than twelve
(12) inches, but not more than six (6) feet; and, which shall not extend upward to a height greater than
the highest portion of the roof or any exterior wall, whichever is highest.

1.2.10 Roof Sign.
A roof sign is an attached sign, other than a wind device sign, wholly erected on, affixed to, or supported
by a roof or roof structure of a building.
1.2.11 Signs not visible from street.
A sign not visible from street is any sign where no part of such sign is visible from any public street.
1.2.12 Signs on mailboxes and/or newspaper racks.
A sign located on mailboxes, newspaper vending machines which identify the owner and address of the
premises or the name of the newspaper sold or subscribed to, provided that such devices are not placed
so as to interfere with the safe movement of pedestrians or vehicular traffic.
1.2.13 Signs on outdoor machines, devices and/or equipment.
A sign located on an outdoor machine, device, or equipment which displays the trademark, trade name,
manufacturer, cost, or operating or service instructions or similar information but does not advertise the
business where located. This includes but is not limited to signs on vending machines, fuel dispensing
pumps, telephone facilities, automatic teller machines, automotive vacuum cleaners and similar
machines, devices or equipment.
1.2.14 Temporary Sign.
A temporary sign is a ground sign that is used to communicate or advertise a single event which has not
yet occurred and which is temporary in nature. Examples of temporary signs include, but are not limited
to, signs advertising grand openings, future construction projects, and foal estate listings. A temporary
sign shall have not more than thirty-two (32) square feet of effective sign area and be mounted on poles
or posts less than four inches in width or diameter. A temporary sign shall not be located within any
public street median or within ten (10) feet of any curb line, and shall be removed within ten (10) days
after the event being communicated or advertised on the sign. No more than one (1) off-premise sign
advertising the sale or lease of one (1) piece of real property or one (1) real estate subdivision or
development sign shall be placed on any one (1) premise.
1.2.15 Utility Sign.
A utility sign is a sign marking utility or underground communication or transmission lines.
1.2.16 Vehicle Sign.
A vehicle sign is a sign displayed or used upon vehicles, trailers or aircraft, unless such vehicle, trailer
or aircraft on which such sign is displayed is permanently stationed or regularly used as a fixed location
to serve the same or similar purpose of a permanent or portable sign not affixed to a vehicle, trailer or
aircraft.
1.2.17 Wall Sign.
A wall sign is an attached sign, other that a wind device sign, wholly affixed to, supported by, or painted
upon the wall of any building and which is not a projecting sign.
1.2.18 Wind Device Sign.
A wind device sign is a flag, banner, pennant, streamer, inflatable balloon or similar device made of
cloth, canvas, plastic, or other similar flexible material, with or without a frame or other supporting
structure, and used as a sign.

Article 2. SIGN REGULATIONS
Sec. 2.1 Types of Signs Allowed.
Ground, monument, attached, wall, roof, wind device, and projecting signs are allowed within this
Special Sign District. The existing off-premise sign is allowed within the Special Sign District as a
registered non-conforming off-premises sign, registered under Sign Permit #91051; and, its allowance in
the Special Sign District does not change is classification as registered non-conforming. In addition, the
following types of signs exempt from permit requirements of the City of Denton arc allowed within the
Special Sign District, including: flags; holiday signs; private traffic control signs; signs not visible from
street; signs on mailboxes and newspaper racks; signs on outdoor machines, devices and equipment;
temporary signs; utility signs; and, vehicle signs.
Sec. 2.2
The following

Sec. 2.3 Number of Signs Allowed.
The number of ground signs allowed is limited to those shown on the approved sign site plan. There is
no limit on the number of wall, roof, temporary, wind device, and projecting signs.
Sec. 2.4 Maximum Effective Area Allowed.
2.4.1 Ground Signs.
The effective sign area for each type of ground sign shall be as follows:

2.4.2 Projecting Signs
The total effective sign area of all projecting signs on a building shall not exceed twenty (20)
percent of the wall area on which such signs are located.
Sec. 2.5
2.4.3 Roof Signs
Roof signs shall not extend laterally beyond the exterior walls of the building and shall have a
maximum height and effective area as follows:

*For each story above 2 stories, the effective area of the sign may be increased by fifteen (15)
square feet per story, to a maximum of 135 square feet.

2.5.1 Ground Signs.
The maximum height for each type of ground sign shall be as follows:

2.5.2 Projecting Signs.
Projecting signs shall not extend upward to a height greater than the highest part of the roof or
any exterior wall, whichever is higher.
Sec. 2.6 Location & Minimum Setbacks of Ground & Projecting Signs.
2.6.1 Ground Sign "A".
There shall be a maximum total of one (1) Ground Sign "A" within the Special Sign District.
Ground Sign "A" shall be located as shown on the Sign Site Plan, centered on the common
property line between Lots 1 & 2. The minimum setback shall be sixty (60) feet from the
curbline of the frontage road of 1-35E, adjacent to the property, or forty-five (45) feet from the
property line adjacent to the frontage road of 1-35E, whichever is greater. There shall be a
minimum setback of ten (10) feet from any rear yard property line. There shall be no side yard
setback.
2.6.2 Monument Sign "B".
There shall be a maximum total of two (2) Monument Signs "B", with one located on Lot 1 and
one located on Lot 2, within the front yard area of each lot, between the property line at the
adjacent 1-35E service road and the building. The minimum setback shall be twenty (20) feet
from the curbline of the frontage road of 1-35E, adjacent to the property; and, there shall be a
minimum ten (10) foot setback from any side and rear yard property line. The minimum setback
may be reduced to a minimum of fifteen (15) feet fi.om the curbline of the frontage road of 1-
35E, adjacent to the property, if the height of the sign is no higher than the setback. (i.e. setback
= 15', height = 15' or less)

2.6.3 Monument Sign "C".
There shall be a maximum total of two (2) Monument Signs "C", with one located on Lot 1 and
one located on Lot 2, within the side yard of each lot, between the 40' Private Access Easement
and the building. The minimum setback shall be eighty (80) feet from the curbline of the
frontage road of 1-35E, adjacent to the property; and, there shall be a minimum ten (10) foot
setback from any side and rear yard property line.
2.6.3 Monument Sign "D".
There shall be a maximum total of four (4) Monument Signs "D", with one located on each of
Lots 1 thru 4, within the front yards of each lot, between the 40' Private Access Easement and
the building. The minimum setback shall be twenty (20) feet from the front property line, within
the 40' Private Access Easement; and, there shall be a minimum ten (10) foot setback from any
side and rear yard property line.
2.6.4 Projecting Signs.
Projecting signs shall maintain a minimum setback of twenty (20) feet from the curbline of any
public street and a minimum setback often (10) feet from any side or rear yard property line.
2.7 Signs on a Multi-Tenant Building.
When one of more attached signs are located on a building that is divided and contains more than one
(1) business or use, the regulation of such attached signs as to size shall apply proportionally according
to the gross floor area of each respective business or use.
Article 3. TECHNICAL REQUIREMENTS.
Sec. 3.1 Setback Measurement.
A minimum setback from a curb line or edge of pavement shall be the horizontal distance from a vertical
line extending upward from the back of curb or edge of pavement toward the sign. A ground or
projecting sign may not encroach into that horizontal distance.
Sec. 3.2 Height Measurement.
The maximum height of a ground or roof sign shall be the vertical distance extending upward to the
maximum height allowed for the sign. From that point extend a horizontal line to where the sign is
located. The horizontal line is the maximum height allowed at that location. Within the sign district, the
height may be measured from the principal lanes of 1-35E, its frontage road, or the adjacent ground,
whichever allows the greater height. The natural ground height shall be measured at the center of the
horizontal line extending to the outer extremities of the sign.
Sec. 3.3 Effective Sign Area Measurement.
The effective sign area is the area enclosed by the smallest imaginary regular shape (e.g. parallelogram,
triangle, circle, trapezoid) or combination of regular shapes that will encompass the extreme limits of the
writing, representation, emblem, or other display, together with any material or color forming an integral
part of the display or used to differentiate the sign from the backdrop or structure against which it is
placed. Effective area includes such features as decorative or ornamental elements or features, borders,
trims, but not including any supporting structure which is used solely for the support of the sign, such as

poles, trim covering poles (such as masonry or metal trim), masonry structural members, columns and
cable, or decorative fence, screening device or wall.
3.3.1
Sign copy mounted or painted on a background panel or area distinctively painted, textured or
constructed as a background for the sign copy shall be measured as the area contained within the
outside dimensions of the background panel or surface.
3.3.2
Sign copy mounted as individual letters and or graphics against a wall, fence, screening device,
awning, or fascia of a building or other structure that has not been painted, textured or otherwise
altered to provide a distinctive background of the sign copy shall be measured as the area
enclosed by the smallest regular shape or combination of shapes that will enclose all sign copy.
3.3.3 Where there are a number of sign faces or more than one (1) sign on a supporting structure, the
following shall apply:
3.3.3.1 Where there is a single sign face, the effective sign area will be the area of the single
face only.
3.3.3.2
Where there are two (2) sign faces, if the interior angle between the two (2) faces is
forty-five (45) degrees or less, the effective sign area will be the area of one (1) face
only; if the angle between the two (2) sign faces is greater than forty-five (45) degrees,
the effective sign area will be the sum of the area of the two (2) faces.
3.3.3.3 Where there are three (3) or more sign faces, the effective sign area will be the sum of
the areas of each of the faces.
3.3.3.4
All signs on a single supporting structure shall be measured together as though they
were one (1) sign to determine the total effective area, except that signs separated by
more than thirty-six (36) inches of air space at every point between the signs shall be
measured separately and added together to determine the total effective area.
Sec. 3.4 Illumination.
3.4.1 Signs may be illuminated internally or externally. If signs are illuminated with external light
fixtures, the fixtures shall be shielded to contain direct illumination to the effective area of the
sign.
3.4.2
Illuminated signs are not permitted if they are illuminated in such a manner, to such intensity, or
without proper shielding, so as to constitute a hazard to the operation of motor vehicles upon a
public street or substantially interfere with the reasonable enjoyment of residential property; or if
they have any type of intermittent illumination, including flashing, fading, revolving or blinking
lights, or any type of moving, traveling or changing message by means of illumination,
excluding temporary Christmas lights and changeable message signs that meet the standards
described in Section 3.5.

Sec. 3.5 Changeable Message.
3.5.1 A changeable message shall be allowed on Ground Sign "A", so long as the effective area of the
changeable message is less than 50% of the total effective sign area of the sign.
3.5.2
Effective sign area of Ground Sign "A" with changeable copy may be translucent with internal
or back lighting if the translucent material is white and if the internal or back lighting produces
illumination that is uniform and does not create a hazard for motorists or pedestrians.
3.5.3
No illuminated portion of Ground Sign "A" or any element thereof may tam on or off, change
brightness, or otherwise: (a) produce apparent continuous motion; (b) cause any time or
temperature message to change more than once each five (5) seconds; or (c) cause any other
message or picture to change more than once each twenty (20) seconds.
Sec. 3.6 Inflatable Devices.
The following regulations shall apply to any balloon or other type of inflatable device used as a sign:
3.6.1 It shall be securely anchored at all times.
3.6.2
It shall not extend to a height greater than thirty (30) feet above ground level unless it is attached
to the roof of a building, in which case it shall not extend more than ten (10) feet above the
highest part of a roof.
3.6.3 It shall not be allowed to extend over any public street, right-of~way, or access easement or over

Sec. 3.7 Color.
Ground signs shall be done in colors and appearance that are compatible with or complementary to their
respective proposed buildings within the sign district.
3.7 Landscaping.
Except for Ground Sign "A", ground and monument signs shall be surrounded by a landscaped area
equal in area to the effective sign area of the sign.
3.8 Material
Monument signs shall use only masonry, HDO materials, or metal panels finished with a masonry
appearance in the supporting structure of the sign.
