2002-021ORDINANCE NO. ~00~-0~ [ AN ORDINANCE OF THE CITY OF DENTON, TEXAS APPROVING CERTAIN AMENDMENTS TO THE LAND USE PLAN MAP TO THE LAND USE ELEMENT OF THE DENTON COMPREHENSIVE PLAN; PROVIDING A SEVEABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE (CA01-0002) WHEREAS, on December 7, 1999, the City Council pursuant to Ordinance No. 99-439 adopted the 1999-2020 Denton Comprehensive Plan (the "Denton Plan"); and WHEREAS, the Denton Plan contains a Land Use Element which contains a Land Use Plan Map providing guidelines for potential future land uses within the city limits and extraterritorial jurisdiction of the City of Denton (the "Denton Plan Land Use Map"); and WHEREAS, The Denton Plan established, among other things, a Comprehensive Plan amendment requirement in the even of a request for land uses that are inconsistent with the Denton Plan; and WHEREAS, the City of Denton Planning and Development Department initiated comprehensive plan amendments for certain areas as directed by City of Denton City Council; and WHEREAS, on December 5th, 2001, the Planning and Zoning Commission recommended approval for revisions to the Denton Plan Land Use Map as more particularly described in Exhibit A attached hereto and made a part hereof by references (the "Denton Plan Amendments"); NOW THEREFORE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Denton Plan is hereby amended so as to adopt the Denton Plan Amendments. SECTION 2. City Staff is directed to change the Denton Plan Land Use Map to reflect the Denton Plan Amendments. SECTION 3. If any provision or the application thereof of any provision of this ordinance to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or application, and to this end the provisions of this ordinance are severable. SECTION 4. This ordinance shall become effective immediately from and after its passage. PASSED AND APPROVED this the ~--~ day of EUL[ NE BROCK, MAYOR 2002. Changing the approximate area surrounded by Scripture, Jagoe, Oak, and Bonnie Brae from Downtown University Core to Existing Neighborhood / Infill Compatibility. B. Changing the approximate area surrounded by Oak, Carroll Blvd, the rear parcel line between Oak and Hickory, and Welch Street from Downtown University Core to Existing Neighborhood / Infill Compatibility. C. Changing the approximate area designated as Industrial Centers west of 1-35W and north of Corbin Road to Neighborhood Centers. D. Changing the approximate area north of US 380 and east of Loop 288 to Geesling Road from Industrial Centers to Employment Centers. With the exception of properties of Safety Kleen, United Copper Industries and the Box Plant. \ 2 E. Changing portions of the Community Mixed Use Centers area along Ft Worth Drive, south of 1-35E to Industrial Centers and Employment Centers. F. Changing portions of the Regional Mixed Use Center, Employment Cemer and Neighborhood Centers on the east side of Mayhill Road south of E.
