AN ORDINANCE AMENDING THE DENTON PLAN 1999-2020 BY ADOPTING AN
AMENDMENT TO THE LAND USE PLAN OF THE LAND ELEMENT OF THE DENTON
PLAN FOR THE CITY OF DENTON, TEXAS; THE AREA FOR AMENDMENT
ENCOMPASSING APPROXIMATELY 9.1 ACRES AND GENERALLY LOCATED
SOUTHEAST OF THE INTERSECTION OF LOOP 288 AT SHERMAN DRIVE,
APPROXIMATELY 510 FEET EAST OF POINSETTIA BOULEVARD. PROVIDING A
SAVINGS AND REPEAL CLAUSE; AND PROVIDING AN EFFECTIVE DATE. (CA02-
0001)
WHEREAS, Bel Air Development, LTD initiated a comprehensive plan amendment to
the land use plan of the land element of the Denton Plan for 9.1 acres of land from Community
Mixed Use Activity Centers to Neighborhood Centers which is more particularly described in
Exlfibit "A" attached hereto and made a part hereof by reference (the "Land Use Plan
Amendment"); and
WHEREAS, on December 7, 1999, the City of Denton adopted the Denton Plan, 1999-
2020; and
WHEREAS, on May 22, 2002, the Planning and Zoning Commission held a public
heating and recommended approval of the Land Use Plan Amendment; and
WHEREAS, the City Council, after a public hearing on June 18, 2002, finds that the
recommended Land Use Plan Amendment is in the best interests of the health, safety and general
welfare of the citizens of the City of Denton, Texas; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Council hereby approves the Land Use Plan Amendment to the
Denton Plan, 1999-2020 described in the attached Exhibit "A".
SECTION 2. Ail ordinances or parts of ordinances in fome when the provisions of this
ordinance became effective, which are inconsistent or in conflict with the terms or provisions
contained in this ordinance, are hereby repealed to the extent of any such conflict only. The non-
conflicting sections, sentences, paragraphs, and phrases shall remain in full force and effect.
SECTION 3. The City staff is directed to change the land use plan map to the Denton
Plan in conformity with the Land Use Plan Amendment. Until such map change is made a copy
of this ordinance shall be attached to the Denton Plan, 1999-2020 showing the Land Use Plan
Amendment.
SECTION 4: This ordinance shall become effective immediately upon its passage and
approval.

The Comprehensive Plan Amendment encompasses approximately 9.1 acres. The total 9.1 acres
will be amended from Community Mixed Use Activity Center to Neighborhood Center.
