2001-003S \Our Documents\Ordmances\01WEMA COOP Ordinance doc O INANCE NO .J00/-D 9 AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DENTON AND THE FEDERAL EMERGENCY MANAGEMENT AGENCY, REGION VI ("FEMA"), TO PROVIDE FOR AN ALTERNATE CONTINUITY OF OPERATIONS FACILITY AT NORTH LAKES PARK AND RECREATION CENTER IN THE EVENT FEMA'S PERMANENT FACILITY IS UNAVAILABLE IN AN EMERGENCY, AUTHORIZING THE EXPENDITURE OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The City Manager or his designee is hereby authorized to execute a Memorandum of Understan&ng between the City of Denton and the Federal Emergency Management Agency, Region VI ("FEMA"), to provide for an alternate commmty of operations facility at North Lakes Park and Recreation Center in the event that FEMA's permanent facility is unavailable in an emergency, a copy of which is attached hereto and made a part hereof SECTION 2 The City Manager or his designee is authorized to make the expenditures as set forth in the attached Memorandum of Understanding SECTION 3 This ordinance shall become effective immediately upon its passage and approval EULINE BROCK, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPR/OVED AS TO LEGAL FORIV~ BY ~~ MEMORANDLIM Oi~ LINDERSTANDING DENTON PARKS Federal Emergency Management Agency Region VI and City of Denton, Texas The following Memorandum of Understanding (the Agreement) sets forth the terms of agreement between the Federal Emergency Management Agency (FEMA) and the City of Denton, Texas, with regard to implementation of the FEMA Region VI Cont~nmty of Operatmns (COOP) Plan L Purpose of A~reement The purpose of this Agreement ~s to establish responsibilities of the part~es as they relate to a COOP s~tuat~on, which would cause Region VI personnel to operate ~n an altemate famhty I II. Duration of A~reement The Agreement ~s effective upon signature of the FEMA Region VI D~rector and the Denton C~ty Manager, and shall remain in effect until one, or both, part,es cancel, ~n accordance w~th the terms set forth herein III. Pro~ram Description COOP 1s a program whereby the FEIMA Region VI personnel must be capable of operating on a continual basis, even ff the famhty currently being occupied ~s umnhab~table In th~s instance, Region VI personnel would have to be available to prowde d~rect~on and gmdance to their representative states during emergency declarations To do so, an off-site faclhty must be made available to house emergency personnel, as prescribed in the Region VI COOP Plan IV. General Provisions It ~s understood by both the Denton City Manager and the Region VI D~rector that each agency should be capable of fulfilhng ~ts responsibilities under th~s Agreement If at any t~me either party is unable to perform ~ts fanct~ons under this Agreement, the affected party shall ~mmedlately provide notice to the other V. Responsil~ilitles of tire Parties Ninder A~reement In consideration of the mutual covenants of the part,es to th~s Agreement, the City of Denton, Texas and FEMA Region VI agree that their responsibilities under th~s agreement are as follows Ao City of Denton. Texas ~rees (durlno an eme~ency when Re,ion VI's permanent £acility Is unawilal~le due to the eme~ency) to: (1) Prowde office space m an facdlty located at 2001 W W~ndsor, in the North Lakes Park and Recreation Center to Region VI personnel dunng COOP s~tuat~ons M~mmum space shall include the game room and an accompanying office w~th 874 sq ii (the "Emergency Fac~htles") (2) Prowde access to the aforementioned space as detenmned by the s~tuat~on, which could revolve aiier-hours and weekend hours of operatton (3) Prowde access entry keys or a famhty manager to Region VI personnel, as determined by the s~tuatlon (4) Prowde telephone and computer connections, already in place, and allow access to Region VI personnel on a case-by-ease reimbursable bas~s (5) Prowde access to parking and restroom facd~t~es (6) Prowde access to tables and chmrs for personnel as deternnned by the s~tuat~on (7) Cease act~wt~es which would preclude access to the room or moms being occupied B. Re, ion VI a~ree# (durin~ an emer~encjt wl~en Re,ion Vl's permanent facility is unavnilnl~le due to the emer~encjt) (1) Prowde administrative supphes and eqmpment to conduct operations (2) Keep the Emergency Facilities m a neat and orderly fashion (3) Follow the C~ty of Denton estabhshed rules for parking and famhty entry (4) Not interfere m ongoing recreation center operattons located ~n other parts of the famhty Should additional reqmrements be necessary, Region VI agrees to coordinate w~th the Parks and Recreation D~rector, located w~th~n the C~ty Emergency Operations Center (EOC) (5) Remaburse the C~ty all costs assocmted w~th renting the Emergency Factht~es NOTE. In any situation where the Emergency Fatalities are being used by the city for emergency operations, the City EOC Director reserves the right to withdraw support to Region VI xf space Is not avmlable VI. AIIo~tiott of Costs A. The Emergency Facilities shall be made available free of charge for up to 72 hours, to include utlht~es Should other costs be incurred, such costs will be the full responsibility of the participants who recur them B. An additional option is avatlable to rent the entire facility, should the need arise In such an incident where the entire facility is needed, a rate of $500 00 per day, including staff, will be assessed VII.
