AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING CONTRACTS FOR
THE PURCHASE OF THIRTEEN (13) REFUSE TRUCKS AND ONE (1) HEAVY DUTY
CAB/CHASSIS, PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFORE, AND
PROVIDING AN EFFECTIVE DATE (BID 2600 - REFUSE TRUCKS AND HEAVY DUTY
CAB/CHASSIS AWARDED IN THE TOTAL AMOUNT $1,720,320)
WHEREAS, the C~ty has sohc~ted, receaved and tabulated competmve bads for the purchase
of necessary materials, cqmpment, supphes or servaces m accordance with the procedures of State
law and C~ty ordinances, and
WHEREAS, the City Manager or a designated employee has reviewed and recommended
that the hereto described b~ds are the lowest responsible bids for the materials, eqmpmem, supplies
or services as shown ~n the "Bid Proposals" submitted therefore, and
WHEREAS, Section 271 905 of the Local Government Code allows the City to award a
contract to a bidder having ~ts pnncipal place of business m the C~ty lf~ts bid ~s wathm three per cent
of the lowest bid price received from a nonresident bidder if the governing body determines m
writing, that the local bidder offers the City the best combination of price and addmonal economm
development opportunities for the City created by the contract award, ~ncludmg the employment of
residents of the City and increased tax revenues to the C~ty, and
WHEREAS, the City Manager or a designated employee has rewewed the here~n described
bids for the materials, equipment, supphes or services as shown in the "Bid Proposals" submitted
therefore and represems to the C~ty Council that the hereto described local b~dder's bid ~s w~thm
three per cent of lowest bid price received from a nonresident b~dder, and
WHEREAS, the C~ty Councd has provided in the City Budget for the appropriation o f run,ts
to be used for the purchase of the materials, eqmpment, supplies or services approved and accepted
herein, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the number 2, 3, 6 and 7 ~tems in the following numbered bids for
materials, cqmpment, supphes, or servmes, shown m the "Bid Proposals" on file ~n the office of thc
C~ty Purchasing Agent, are hereby accepted and approved as being the lowest responsible b~ds for
such ~tems and
The C~ty Council hereby determines that the vendor set forth below for items 1, 4 and 5 has
~ts pnnc~pal place ofbumness ~n the C~ty of Denton, Texas, ~ts b~d ns within three per cent of the
lowest b~d price received from a nonresident bidder and such local bidder offers the City the best
combanat~on of price and add~tmnal economac development opportumtles for the City created by this
contract award The number 1, 4 and 5 items in the following numbered bids for materials,
equipment, supplies, or serwces from the below described local bidder and as shown in the "Bid
Proposals" on file an the office of the C~ty Purchasing Agent, are hereby accepted and approved

SECTION II That by the acceptance and approval of the above numbered items of the
submitted bids, the City accepts the offer of the persons submitt~ng the bids for such items and
agrees to purchase the materials, equipment, supplies or services m accordance v~th the terms,
specifications, standards, quantities and for the specified sums contained in the Bid Invitations, Bid
Proposals, and related documents
SECTION III That should the City and persons submitting approved and accepted items and
of the submitted bids wish to enter into a formal written agreement as a result of the acceptance,
approval, and awarding of the bids, the City Manager or his designated representative is hereby
authonzed to execute the written contract which shall be attached hereto, provided that the written
contract is m accordance with the terms, conditions, specifications, standards, quantities and
specified sums eontmned m the Bid Proposal and related documents herein approved and accepted
SECTION IV That by the acceptance and approval of the above numbered items of the
submitted bids, thc City Council hereby authorizes the expenditure of funds therefor m the amount
and m accordance with the approved bids or pursuant to a written contract made pursuant thereto as
authorized herein
SECTION V That this ordinance shall become effective immediately upon its passage and
approval
