DEVELOPMENT 100 (PD-100) DISTKICT TO ALLOW FOP. SINGLE FAMILY USES, THE
SUBJECT PP.OPEP.TY BEING LOCATED NOP.TH OF ROBINSON P.OAD, EAST OF
TEASLEY LANE, PP. OVIDING A SAVINGS CLAUSE, PP.OVIDING FOP. A PENALTY IN
THE MAXIMUM AMOUNT OF $2,00000 FOP. VIOLATIONS THEKEOF, AND
PP.OVIDING FOP. AN EFFECTIVE DATE (ZP00-0008)
WHEREAS, on February 1, 2000, the City Council adopted Ordinance No 2000-046
which estabhshed certmn residential Interim regulations (the "P.esldentlal Interim P.egulatlons"),
WHEREAS, ;he P.emdentlal Interim P.egulations established, among other things, a
Zoning Plan requirement in the event of a request to rezone property, and
WHEREAS, on June 21, 2000, Lloyd Blaylock applied for a change m zoning for 34 1
acres of land located north of P.obmson P.oad, east of Teasley Lane, amending Planned
Development (PD-100) and changing Single Family (SF-7[c]35) zoning dmtnct classifications
and land use designations to be included in Planned Development 100 (PD-100) zoning district
classification and land use designation w~th the ~ment to develop a single family subdivision with
open space which application includes a Zomng Plan, a copy of which is attached hereto as
Exhibit "B" (the Zomng Plan"), and
WHEREAS, on February 14, 2001, the Planning and Zoning Commission recommended
approval of the requested change m zomng and the Zoning Plan, and
WHEREAS, the C~ty Council finds that the Zomng Plan, with the conditions imposed
here~n, meets the reqmrements of the P.emdentml Interim Kegulatlons and ~s consistent with the
approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFOP.E,
THE COUNCIL OF THE CITY OF DENTON HEKEBY ORDAINS
SECTION 1 The zoning chstrlct clasmficat~on and land use designation of the 34 1 acres
property descnbed in the legal description attached hereto and incorporated herein as Exhibit A
~s changed by amending Planned Development (PD-100) and changing Single Family (SF-
7[c]35) zoning thstnct classifications and land use designations to be included in Planned
Development 100 (PD-100) zomng dmtnct classification and land use demgnatlon under the
comprehensive zoning ordinance of the C~ty of Denton, Texas to allow a tangle family
subdlvm~on with open space The Zomng Plan and said change m zoning are hereby approved
subject to the following conditions
The pnvate park site shown on the Zomng Plan shall be deed restricted for use as a park
site with ownership thereof being vested ~n a home owners association ("HOA") The
pa~k site shall be platted as a separate lot which shall be designated thereon as a private
park s~te The HOA documents shall contain a prows~on for adequate mmntenance of the
park s~te Much prowslon shall not be amended, nor shall the HOA be dissolved, w~thout
the prior written approval of the C~ty of Denton The HOA documents and deed
restriction must be submitted to the City Attomey for review and approval prior to final
plat approval
SECTION 2 The C~ty's official zomng map is amended to show the change in zoning
district classfficat~on
SECTION 3 If any prows~ons or the application thereof to any person or clrcmnstance ~s
held lnvahd by any court, such ~nvahd~ty shall not affect the vahdlty of other provisions or
applications, and to this end the prows~ons of this ordinance are severable
SECTION 4 That any person wolatmg any prowslon of this ordinance shall, upon
conwct~on, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
~s wolated shall conmtute a separate and d~st~nct offense
SECTION 5 That th~s ordinance shall become effective fourteen (14) days from the date
of~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of th~s ordinance to
be published twine m the Denton Record Chromcle, officml newspaper of the City of Denton,
Texas, w~tlun ten (10) days of the date of its passage

WHEREAS, the Resadentlal Interim Regulataons established, among other things, a

WHEREAS, on March 6, 2001, by Ordinance No 2001-1,1t2he City Council approved a
change in zomng and Zomng Plan for 34 1 acres of land, to be included in Planned Development
(PD-100) zonang d~stnct classlfieataon and land use designation, and
WHEREAS, on June 21, 2000, Lloyd Blaylock submitted a Project/Detmled Plan for 34 1
acres of land located wathln PD-100 wath the intent to develop a single family subdivision with
open space, and
WHEREAS, on February 14, 2001, the Planning and Zoning Commission recommended
approval ora Project/Detailed Plan for such 34 1 acres, and
WHEREAS, the City Couneal finds that the Project/Detailed Plan is consistent wath the
approved Zonang Plan, meets the requirements of the Residential Interim Regulations, and is
consastent with the approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

SECTION 1 Ordinance No providing for the approval of a Planned Development
Zoning Dastnet Clasmfioataon and Use Designation for the property described as PD-100 is
amended by approvang the Projeet/Detmled Plan attached hereto and incorporated herein by
reference as Exhabat B for 34 1 acres of land located within PD-100, more particularly described
by the legal descnptaon attached hereto and incorporated herein by reference as Exhibit A,
subject to the following condatlons
The private park sate shown on the Zonang Plan shall be deed restricted for use as a park
site wath ownership thereof being vested in a home owners association ("HOA") The
park sate shall be platted as a separate lot which shall be designated thereon as a private
park sate The HOA documents shall contmn a provision for adequate maintenance of the
park site which provision shall not be amended, nor shall the HOA be d~ssolved, without
the prior written approval of the City of Denton The HOA documents and deed
restriction must be submitted to the City Attorney for review and approval prior to final
plat approval
SECTION 2 The provlmons of this ordmance as they apply to the 34 1 acres shown m
the Project/Detmled Plan herein approved shall govern and control over any conflicting

SECTION 5 Any person wolat~ng any prowmon of this ordinance shall, upon
conmctmn, be fined a sum not exceeding $2,000 00 Each day that a prowslon of thru ordinance
is violated shall constitute a separate and distinct offense
SECTION 6 This ordinance shall become effective fourteen (14) days from the date of
its passage, and the C~ty Secretary is hereby directed to cause the caption of this ordinance to be
published twice m the Denton Record Chromcle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
