mended by approvmg the Projec~etmled PI~ attached hereto ~d ~nco¢orated here~n by
reference ~ Exhibit B for 34 1 acres of l~d located w~n PD-100, more p~mul~ly described
by the legal description attached hereto ~d ~nco~orated here~n by reference as Exhibit A,
subject to ~e following conditions
The private park s~te shown on the Zomng PI~ shall be deed restricted for use as a p~k
s~te w~th ownership ~ereof bemg vested ~n a home owners association ("HOA") The
p~k rote shall be platted as a sep~ate lot whmh shall be designated thereon as a private
p~k s~te ~e HOA documents shall contmn a prowsmn for adequate mmntenance of the
p~k s~te w~ch prows~on sh~l not be mended, nor shall the HOA be dmsolved, w~thout
the prior written approval of the City of Denton The HOA documents and deed
restriction must be submitted to the City Attomey for review and approval prior to final

SECTION 2 The provisions of tbas ordinance as they apply to the 34 1 acres shown in
the ProJect/Detailed Plan herein approved shall govern and control over any conflicting
provisions ofOrdmanceNo 2001-11~.

SECTION 3 A copy of this ordinance shall be attached to Ordinance No showing
the amendment herein approved
SECTION 4 If any provisions or the apphcataon thereof to any person or circumstance is
held invalid by any court, such invalidity shall not affect the validity of other provisions or
apphcataons, and to this end the provisions of this ordinance are severable
SECTION 5 Any person violating any provision of this ordinance shall, upon
convactlon, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense
SECTION 6 This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
pubhshed twice m the Denton Record Chronicle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
