AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING A CONTRACT FOR
THE PURCHASE OF ONE (1) SUBURBAN, PROVIDING FOR THE EXPENDITURE OF
FUNDS THEREFORE, AND PROVIDING AN EFFECTIVE DATE (BID 2658 - SUBURBAN
AWARDED 1N THE TOTAL AMOUNT $26,486 75)
WHEREAS, the Ctty has sohmted, recetved and tabulated competlttve btds for the purchase
of necessary materials, eqmpment, supphes or servtces m accordance wtth the procedures of State
law and Ctty ordinances, and
WHEREAS, the Ctty Manager or a destgnated employee has revtewed and recommended that
the herem described btds are the lowest responsible btds for the materials, eqmpment, supphes or
servtces as shown m the "B~d Proposals" submttted therefore, and
WHEREAS, Sectmn 271 905 of the Local Government Code allows the Ctty to award a
contract to a bidder hawng its pnnmpal place of business m the C~ty tftts btd ~s wlthtn three per cent
of the lowest btd price recetved from a nonrestdent btdder ~f the governing body determines ~n
writing, that the local b~dder offers the C~ty the best combtnat~on of price and additional economic
development opportumt~es for the C~ty created by the contract award, ~ncluthng the employment of
residents of the Ctty and increased tax revenues to the Ctty, and
WHEREAS, the Ctty Manager or a destgnated employee has revtewed the herren described
btds for the materials, eqmpment, supplies or services as shown ~n the "Btd Proposals" submttted
therefore and represents to the C~ty Council that the herren described local btdder's btd ts wtthln
three per cent of lowest btd price received from a nonrestdent btdder, and
WHEREAS, the Ctty Council has provtded tn the C~ty Budget for the appropriation of funds
to be used for the purchase of the materials, eqmpment, supphes or services approved and accepted
herren, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SI~CTION I That the following purchase ofmatenals, eqmpment or supphes, as described tn
the "Bid Invltanons" "Bid Proposals" or plans and spectficat~ons on file tn the office of the C~ty
Purchasmg Agent, are hereby accepted and approved as being the lowest responstble btds for such
ttems and
The Ctty Council hereby determines that the vendor set forth below for the purchase, has tts
prmmpal place of business tn the C~ty of Denton, Texas, ~ts btd ~s wtthtn three per cent of the lowest
btd price received from a nonrestdent b~dder and such local b~dder offers the Ctty the best
combtnatton of price and addmonal economic development opportumttes for the Ctty created by th~s
contract award

SECTION II That by the acceptance and approval of the above numbered items of the
submitted bids, the City accepts the offer of the persons submttt~ng the b~ds for such ~tems and agrees

spemficatmns, standards, quantities and for the spemfied sums contained ~n the B~d Invitations, Bid
Proposals, and related documents
SECTION III That should the City and persons submitting approved and accepted 1terns and
of the submitted b~ds wmh to enter into a formal written agreement as a result of the acceptance,
approval, and awarding of the b~ds, the Ctty Manager or h~s designated representative ~s hereby
authorized to execute the written contract whmh shall be attached hereto, provided that the written
contract ~s m accordance w~th the terms, cond~tmns, specifications, standards, quantities and
specified sums contmned m the B~d Proposal and related documents here~n approved and accepted
SECTION IV That by the acceptance and approval of the above numbered ~tems of the
submitted b~ds, the C~ty Counml hereby authorizes the expenditure of funds therefor ~n the amount
and ~n accordance with the approved b~ds or pursuant to a written contract made pursuant thereto as
authorized here~n
SECTION V That th~s ordinance shall become effective ~mmed~ately upon its passage and
approval
